This post is for my colleague.
He is on J1 visa from 07/01/2005 thru 06/30/2007. He will switch visa from J1 to H1B and have gotten I-797. He had to leave for his home country during preparing the application document for I-797. So his previous I-94 was taken away when he left here and he has gotten a new I-94. When he started preparing the document, the previous number on I-94 was entered on the form but before submitting the document, he asked the person in charge of handling this of our department to use the new number on I-94 instead of the old one for the document. Somehow, the number of I-94 which is on the I-797 issued is the old one. He has little time to re-issue I-797 because start date is very close. We wonder if H1Visa can be issued with I-797 containing old I-94 number. Do you have any experience?
