Have you ever before applied for employment authorization from USCIS?

I am currently working with CPT. What should my answer be to this question? Is CPT a kind of employment authorization. If yes, I never got a EAD document. I only got my social security card. The school handled all the paper work. For that reason I do not know which USCIS office they applied and the date they applied. Thanks.

One more important question. Since I am applying for Greencard as a spouse of a US citizen, will my CPT be invalid? I really need to keep working. What are the consequences of this? Thanks.

Answer should be yes. Make a copy of what you have and submit with the I765 application form. :D You cannot take up employment in the US, without a work authorization, irrespective of what is called...:rolleyes:

CPT does not provide an EAD or a card of any kind. It is issued by the International Student Center at the university by simply noting on student's I-20 that he/she is authorized to work at such and such company for such and such time period.

You never technically applied for an employment authorization with USCiS, so I would mark "no". If you mark "yes", USCIS may look for your application, and they will never find it since you never sent any applications in.

Your CPT is valid as long as you maintain your F-1 status. Even if you apply for AOS, but you don't start working with AOS EAD, you theoretically would still be in F-1 status. However, you can just start working with AOS EAD when it arrives. I did that - but with OPT EAD - until AOS EAD arrived.
