I 765 EAD Renewal- Help Needed

Hi,

Since my company Attorney is not co operative, i am filing my EAD
Renewal by myself.

EAD is getting expired in the middle of Feb 2004

Can i file my Renewal 5 months in Advance.

I have few Questions in that i 765 application.

My i 485 is pending (AOS)- Employment based greencard.

1) What alphabets & number should come on Block.no 16.
Eligiblity under 8 CFR 274a.12.
( ? ) (? ) ( ? )

2) what date should i give under block no 11.
in the field( Which INS office & Date)
Mine is TSC (TX service center)
block no 11. says
Have you ever before applied for EAD from INS ?

Yes (if yes , complete below) No

Which INS Office? Date(s)
(is that EAD receipt Date) ???

3) what are all the documents should be attached to
i 765 application.

List of docs I have.
1) i 485 receipt.
2) copy of approved i 140
3) copy of Current EAD which is going to expired in
the middle of Feb 2004
4) Advance parole docs.

Document that i do not have is H1 Extension Petition.

Note: My company has filed h1b Extension , Approved & got
from INS.
But my company is not handling it over to me.

Do i need Enclose copy of that one too.

IF anything is missing , plz let me know

I- 765 application.

List of docs I have.

+2 Photographs, BCIS Fees Check for $ 120, If you have I-94 attach the copy of I-94 both the sides + the Top portion that you received from BCIS with first time EAD( it helps to expedite the process, keep the Check at top then the Top portion then I-765 form then other stuff and write in the cover letter what you have enclosed

Document that I do not have is H1 Extension Petition.

Note: My company has filed h1b Extension, Approved & got
from INS.
But my company is not handling it over to me.
----- That is another problem, you have to handle it do they suspect that you will leave them? It has nothing to do with your EAD you don’t need employer help or lawyer help you can directly file for EAD. Having H1 is no problem you can file for EAD and will get EAD
Do I need Enclose copy of that one too.
--- It means you have new I-94 extended with your H1 extension, no problem if you don’t attach the new I-94, EAD is based on pending I-485, no need to inform the employer that you have applied EAD write your home address on I-765 Form, EAD filing receipt and EAD Card will be sent to your home address

---- Just write out side the envelope in Bold Big letters “ FormI-765, Employment authorization Document (EAD)” And Mail it to correct Service center address.

Just keep all the info ready, No need to send any papers untill requested. Thats what the BCIS officer told me as well the service center they called me to for Pic and Finger ( just one index finger ) printing.

I called and she said no need

Also My i94 got expired in Sep 2002. I have only the expired
i 94 . copy of that was sent to INS when i file i 485. i filed i 485
in oct 2002.

my company applied for h1b extension before i 94 expires.
usually in extended h1b petition, new i 94 is attached at the bottom.

Do i need to attach new i 94 extended.
IN ur reply , you have mentioned not to attach i94 extended.

send the copy of extended or valid I-94 ( front and back)
