Hi guyes can somebody give me an advise. After We send our I751 application, we had stokes interview by phone, today 6 months later, we received interview appointmant. Bud the thing is we are in divorce process. Can I terminate the interview?What will happen if I will not go? Even I am in divorce process, I am worry about my ex-husband, to be forcuss for some investigation or somenthing. plase help me what to do............................ I am despire
 
Thank you for your advice. How long the commence process take? What is the consequence? I will not attend on the interview? What is next?
 
I am prepairing all stuff to leave now. I do not know, what to do. ...... If I reschedule the appointmant, can I get more time like this? thank you for help. I am very appreciate
 
just my 2 cents -- you still in process, you know you have second interview coming, but you are not denied yet. you can (if you are USC) withdrew your application based on divorce filled. this could play in favor comparing to not withdrewing application and waiting for it to be denied (for example by not showing up on your app). what I am trying to say, is that I have seen multiple cases decided by the board (BIA) that board approach was that when there was a divorce and application withdrew before final decision on file came, it looked to the board more like a legitimate marriage when couple is not married not just for immigration purposes (they divorced and withdrew application before decision came). I dont know how this piece of information helps you I gues it may if you consider coming back to US ever again.

allowing a rescheduling an appointment lays in USCIS discretion - they may denied your request to reschedule. in your situation its like 99% chances since you had some much background work by USCIS done (phone interview, now stokes coming etc), so this is a bed idea.

however, if your marriage was entered into a good faith, you got plenty of evidence showing marriage bona fide and been in country for at least couple years, you should still go to the interview, be honest with everything if you can prove your marriage was entered not to evade immigration laws, USCIS may still approve your application. small chances but definately you got more chance than ignoring interview and not showing up at all!

Based on limited information you provided, it seems as if your case is going to be denied. Unless you can demonstrate the following: your marriage wasn't for immigration purposes, with the pending divorce, it looks like it was and a tough USCIS officer can me this case and be proven correct. I haven't had a situation where someone it interviewed via phone after filing for removal of conditions, which might be a new trend. The request for your interview in person doesn't bode well for the approval of your case, which will require that you produce a mountain of evidence to prove your marriage was bona fide.

If I were you, I would request a reschedule and plan my way forward. However, rescheduling might given the impression that your marriage is still viable, thereby misleading USCIS. Withdrawing your application at this stage seems reasonable unless you are willing to prove with your own evidence that your marriage was viable with real intent-wife and husband with no immigration benefits sought by you. I would bet against your chance of convincing USCIS to grant you a 10 years GC. You are in a tough spot and you don't need me to remind you of this issue, the only option is after a denial and notification of removal proceedings, you inform USCIS that you will leave voluntarily without destroying your future immigration applications should you have any. The interview is automaticly terminated? When should I have to leave the country? How should I windraw my case. Do they have any specific form?
