My wife's asylum just got approved 2 weeks ago. She was married to another person and we are in the process of that divorce (still waiting here in New York). We have a kid, 7 months born in the US. Currently I am away because couldn't get a job after graduation. Can we fill the I-710 after the pending divorce because I am having some doubt after reading some of the posting here.

No, the relationship already had to exist when she got asylee status for her to file an I-730. How could she be your wife if she is in the process of divorce? Your future wife may apply for a greencard after one year as an asylee and THEN file an I-130 but there will be a long wait for a visa.

But we have been together for long time; our son existence should be the proof of our relationship and if the divorce have not taken so long, we would have been married long time ago.
