I sent the complete package for I-485, AP and EAD for my wife 3 weeks ago. Today i received Request for Add. Info from INS for the I-693 (medical report). I didn't send it in the original package because I took the advice that INS wouldn't require it until right bef the interview. Now my wife has to schedule the examand have that done. I'd appreciate it if you gurus can help me with the following questions:

1. Do you gurus think INS will approve her advance parole before we send the medical report? She needs to travel within 1 month, and the earliest medical exam she can get is 2 weeks from now.

2. My wife is one month pregnant, and that's another reason we were hoping to postpone the exam. But it seems she has to do it now. Does the pregnancy have any negative impact on the application? I know she can't do the x-ray....

Thanks a lot for helping me, and may God bless all of us.

1) Most likely no, if they sent out RFE.
2) Pregnancy per se does not have negative effect but if her PPD (TB test) is positive, she may not be able to get an x-ray in early part of the pregnancy.

I called USCIS customer service and here is what they told me

I called USCIS twice and got conflicting answers.
First woman said: "As song as you are eligiable for Adjustment of Status, and you have a valid I485 receipt (NOA), you'll get your advance parole. The approval process for I-485 is long, that's why USCIS doesn't want to hold up your emergency to visit your home country. You can do your med. exam even after you return, but that's only going to further delay your AOS."

I called the next day because I was suspicious, and lo behold, the second answer was like this: "We will stop processing anything in the package as soon as we notice key documents are missing, including your EAD and advance parole." This USCIS woman spoke with a strong accent and seemed to be assertive without much to back her theory up. So I asked to spoke to her supervisor. She hung up on me.

Any thoughts?

May God bless all of us.

At this point, I'd suggest you do whatever the RFE asks you to do and wait for the AP. There's not a whole lot else you can do at this point. You can keep asking and getting different answers, but that won't help the case, only creating more anxiety.

In the mean time, schedule an appointment with your local USCIS office to see if they can issue an emergency AP if your wife's trip is for emergent reasons.

If your wife is supposed to travel in one month, and you only sent out the AP application three weeks ago, you were playing with fire anyway.
