I-693 and F1/I20 question

The civil surgeon (or lab) i went to messed up on my bloodwork, so now it will take another two weeks before I receive the I693 form. Is it a huge problem to send in your AoS package without the I693? Can I send it in seperately? All my other paperwork is complete, so i'm just waiting on this.

Another quick question, does anyone know when students loose their legal status in the US? My visa is valid till summer 08, but my OPT expires soon, and my I20 hasn't been signed by my employer (since I am going through Aos). So when will I become 'illegal'?

Thanks for any information,

Mike

I would wait the two weeks get your medical done and submit A COMPLETE AOS package,Also wouldnt want to risk them misplacing the I693 if sent sepperatly you will need I-485 receipt number to reference it to ( it takes 1-2 weeks for you to receive an NOA receipt number for your I485 )if you send in medical seperate you will need that Receipt number to reference the I-693 to your originally submitted AOS, so that would add on an extra week just waiting for NOA's from your AOS.
If you dont send it with AOS You will get an RFE for the I-693,which could delay your case up to a month it takes more than 2 weeks for USCIS to generate RFE and send the RFE, and then the extra week it takes to get the I693 back it may even add on a few extra days to get the ball rolling to move your process forward.

The other question , you will not Become Illegal as you did enter the USA on a visa, You may be out of status which is no big dea & will be pardoned or waived once your AOS is filed.

Thanks for the info! I guess I'll wait to send a complete package. But as far as my status is concerned for the forms do I go by my EAD expiration date or F1 expiration date?

I'm just looking over all my paperwork and have another few quick questions though. The A# on my EAD from my OPT will that number carry on into my AoS case? So everytime the forms ask for my A# is that the one I put down? And my current CIS status is F1 student correct?

Also why am I applying for permanent resident status?- It doesn't give the option for people who married USC's but didn't enter on K1?

For F visa adjusting to Permanent Residence, you check the first box on the I485(an immigrant visa has already been approved or submitting it concurrently with an immigrant visa petition, which if approved, would make a visa immediately available).

Just to clarify, the word illegal is not only use for entry purposes.

For information on out of status, unlawfully present, etc check the two first pages of this link:

When a person apply for adjustment of status is in an authorize stay by the Attorney General until a result of denial or approved is given on the pending application. Be advice that many goverment authorities does not recognize this status as legal per se, since you are not anymore a non immigrant (if your visa is not valid anymore, except the cases of H1B, etc) nor a legal immigrant since you are not "approved" yet. But you will be fine.

Wait for the results (remember that the doctor must sealed the envelope) and attach it to your application. All together.

Good luck,

your F status is no longer valid when you apply for AOS.

Send I-693 with I-485 to avoid and RFE and unnecessary delays.

Your overstay will be pardoned only if you are immediate relative of a USC. so be careful on that.
