Hi

I got I-485 Approval for me and wife.We are traveking out of country
on 4 Dec.We both have Advanced Parole.
Since the first available appointment we are getting for Passport Stamping
is 6 Dec , can we travel on our Advanced Parole or is AP invalid after I-485 approval at point of Entry.

Thanks
Harish

I would imagine that AP is not valid as you are in the country when your 485 is approved. I am not sure though. Try going to your local office and explain the situation. Don't they see limited number of walkins everyday? You should try to get your stamp before travelling.

hktransfer,
AP is valid and you will still be able to use your AP to re-enter US.
However, you maybe given a differed admission and asked to go get your passport stamped ASAP once you enter US.
Search this forum you will find tons of posts with the exact same question that you have asked.
If you want to feel safe, ask your lawyer.

Travel after i-485 approval

I had similar situation. My I-485 got approved one day before my travel to India based on AP. I checked with two attorneys and both of them said that I could still travel based on AP as long as the AP is valid. I-485 approval, as they said, only invalidates H1-B.

When I got back to US yesterday, at the POE the immigration officer never mentioned anything about my I-485 approval and neither did I. He just stamped my AP and gave a I-94 for one year.

Hope this helps.

After your 485 is approved, it is only up to officers based on the UCIS rule to allow you to enter USA or not, but from what I heard, some people were let in on their Advanced Parole after they got their gc approval. They shouldn't stay too long outside USA after they got their approval or they will be not allowed to enter. (there is no information about how long they would stay outside usa when they got their gc approval, but it mentions only that it is up to officers to let you in or not. But I don't see any case that they don't allow anyone to enter on ap when they got their gc approval.)
