Hi,
I (for myself and my wife) recieved courtesy copies of Approval noticesfor (I-797 C Permanent resident Status) on 17-FEB-05 after my wife travelled to India on Advance Parole/EAD while I am in the USA.
My wife is scheduled to return to US on 20-MAR-05.
Can I go ahead and take the Infopass appointment or do I need to wait till my wife comes back from India on 20-MAR-05.
What is the maximum allowed time period after the I-797C apprval for taking the infopass appointment and for getting the Green card.
If we take the appointment on different dates will that be a problem with the
issuance of the plastic greencard or any other benifit.
Do I need to Fedex the Approval notices to my wife in India.

Can my wife come back to USA using EAD/AP or does she need to show the
I-797C approval documents during her port of Entry.
Does she need to fill the I-94 at the Port of Entry.

I also do not have a copy/Original of the I-140 Approval notice.
Do I need to take this for the infopass appointment.

Murali,

1. You can make one InfoPass appointment for yourself and go the and get your passport stamped (Even if you go there together you have to make two different appointments and will be called separately for PP stamping)

2. There is no known problems in benifits for just stamping your PP in different dates.

3. Your wife can return in AP. You don't need to fax anything to her. She need not to tell the officer anything about the approval. Tell him/her only if asked. She will be offered a "differed inspection" and she needs to go to the local INS office within 15 days from arrival. (So take the infopass appointment accordingly)

4. There is no known expiration date for the approval notice and/or passport stamping deadline. The longer you wait, the longer it takes to get the actual green card (An interesting thing to note is that some people have received the green cards in mail without ever going for a Passport Stamping).

5. Yes your wife need to fill in an I-94. The officer will stamp the I-94 with the status "AOS" (means Adjustment of Status), if your wife travels on AP.

I think there is a 90 day deadline from the date of getting your approval. ie., one has to get their PP stamped before 90 days.

Atleast thats what my attorney told me. If I were you, I would go ahead and try to get an appointment yourself immediately. Also, it would be a good idea to tentatively take an appointment for your wife sometime in March...provided the slots are open.

Congrats for ur GC approval!!

Samething happened to me & my spouse.

While my wife was abroad , both our cases were approved in Nov 2004.

I did my PP Stamping with infopass appoinment (in a week) and
during the appoinment I also had finger printing & form signed
for the acutal plastic card application.
Then My case is forwarded for plastic card issuance. So Now Im
waiting for the card issuance as its applied.

My wife case waits for card application now till PP is get stamped & applied for plastic card.


Both are 2 two individual cases , You no need to wait .

Assume what if the spouses cases are approved in different times.

The sooner the Better to join the QUEUE of WAIT for the Card.

for your wife return, ADV parole is good for re-entry.
I-94 is to be filled fr ADV parole entry too.

With Adv parole @ port of entry ,I came to know that need to queue with GC holders.

All the BEST.

Also consult attorney regarding this info.
 
No Deadline

NO DEADLINE as per the INS officer to whom I enquired during my PP stamping
regarding my wife's delay of PP stamp.

I took all the originals & copies of all supporting documents to show
(in case if needed).

The officer asked me
The appoinment letter, approval notice(Original) ,PP,photos
The officer didnt ask me copy of I-140.

Also it may depend on the officer .
Mostly not-needed.
Its better to have a copy if available .
If possible , Take a copy .


In Whc city office, u r gonna get stamped?
