I-539 help part4 - immigrant visa questions
I’m US citizen, my son has B2 visitor visa and he is currently with me in US. He would like to extend his visitor visa for next 6 months. The problem is that a couple years ago I have filled immigrant visa application for him and this case is pending. I’m afraid it may be a reason of extension denial, so I’m think he should answer ‘NO’ in I-539 for Part 4 question 3a and 3b (Are you…an applicant for an immigrant visa? and Has an immigrant petition ever been filled for you…?) Is INS always checking this? What are the consequences if they find it out? Shall we answer ‘YES’ for these questions and send some elaborate concerning it? In this case, what should be said? Have you any advice? I’ll appreciate for your help ASAP.
