I-539 notice not received yet....

my visa expires end of june. I've applied for 6months extension, sent complete application May 15th, that is almost more than a month.

I contacted my bank, I came to know that the check ($ 200) is cashed on may-25th, there is a recept nr at back of the check but almost impossible to read.

I have not received any notice from USCIS till yet, is that normal proces? I called them last week and today, they couldn't provide me any useful information. They searched their system for my last name and no results. They adviced me to wait.

But I am worried because i don't want to have problems in future. If needed I will leave US before visa expiring date to avoid problem with any future entries.

You can leave while the decision is pending. You will not risk anything if you leave before your I-94 expires. You can also stay until the I-539 is adjudicated. You should have received your NOA by now. Try hard to read what is written on your returned cheque. If you can make out the numbers, you should be able to track the application online.
 
as for now there are 3 scenarios:

1: extension accepted before or after expiring date, in this case no problem.

2: extension not accepted before or after expiring date, so after expiring date if I receive negative notice, then I need to leave U.S as soon as possible. But if I receive before expiring date, that is not a problem.

3: no notice till end of june, leaving U.S and what if my extension is accepted after I leave? am I able to book next flight and come back? Since I was planning to visit home for a week, this might work fine. If my I-94 is extended for another 6 months, and if i have left U.S. is that a problem??

about the fact that I have not received any notice yet, I found the following info:
When USCIS receives your application, it will enter your application into their system and send you the 'Receipt'. Keep the receipt in safe place. It may take up to 4 to 6 weeks before you actually receive the receipt. Once USCIS makes the decision, they will mail you either the approval or denial letter. In rare cases, they may call you for an interview at local USCIS office.


If USCIS wants further information before processing your case, all documents you submitted will be returned along with form I-72 that tell you what additional information or documents are required. You should
supply additional documents and information and mail the entire package back to USCIS service center.<

assuming the above information is correct, USCIS didn't need more documents from me, and I should receive a notice this or next week.

edit: I tried to read the case nr, but no luck ;(

You have all three possible scenarios gauged correctly. What more advice do you need? Make your decision and live by it :)

Scenario 3: If my visa is extended while I've left U.S, can I then come back taking next flight?? I assume they mail me new I-94 so I can use that??
 
I do not think you can use an old I-94 or even if they mail you a new one.

Once you re-enter the US, you get a NEW i-94 for whatever the IO at the POE decides and certainly seeing you already spent a long time in the US and filed for an extension but left anyways, will raise questions.
 
No I539 notice yet

Hi,

I have the same problem - I applied for an extension for my mom on May 29th and have not received the notice yet. Her I94 expires on July 9th. Can she stay beyond that date without a notice for the I539 application? Or is she out of status on July 9th if the receipt notice does not arrive by then?
 
I called USCIS, they told me the following:

USCIS received my application, they are 3 months behind of schedule. USCIS received my application on May-24 and I will probably receive an answer within coming 60-70 days. :(

This is not really good news, since I was expecting an answer this or next week. The reason I have not received any NOA is because I provided enough documents.

I spoke with someone about this, since I live in Sandiego there seems to be an easier option. Crossing the US-Mexican border and entering U.S. again, I can apply for an extension or my I-94 will be renewed. Can someone please confirm this??

The last thing I want is to wait 70 days, get a negative answer, leave U.S. and create problems for future entries :eek:
 
Leaving the border and entering will not work. They will not issue you a new I-94. You can stay in the U.S till the decision of the extension is made, BUT YOU NEED TO UNDERSTAND THE RISKS if the extension is denied.

Secondly re-entering too soon will raise suspicions at the POE. If you are on a B-1/B-2 visa you need to spend more time in your home country THAN in the U.S.

What is that you need to complete/do that you requested the extension for? Is that task/deed important enough? You assess the risk and make that call.

I have decided to stay in U.S, my I-94 expires today but since my extension is in proces according to many there is nothing wrong with my stay. In case I receive negative answer from USCIS I'll leave U.S. asap but in case of approved extenion I'll stay. In both cases I've to keep all documents for future entries.

I was wondering, now that my I-94 is expired I am not allowed to leave U.S. but I would like to visit New York,am I allowed to travel within U.S. by airplane now that my I-94 is expired?
