few questions regarding i 485.
I am doing a j1 waiver in south dakota. my labor has been approved and am applying for i 140 approval. i was looking at the state of sd j1 waiver sirte and it said the following: 10. Permanent residence – The application shall include a statement from the employing facility that it will not facilitate the process of acquiring permanent residence for the J-1 physician until after the J-1 physician has been employed in accordance with waiver program requirements for at least two years
Now my lawyer says that i cannot apply for i 485 till the third year is over. is it true. can i apply at the end of year 2 as stated above. what is the bcis position on the i 485 application if applied before 3 years.
also is it true that i can change employment 6 months after the date of i 485 application. does it have to be a similar job or can i go back to train further like a fellowship, or post- doc degree.
