I have a receipt of an I-485 pending through my employer (I have an H1B). I have also just recieved my EAD.

My husband got his greencard after we were married & I'm applying as his derivate. (the company I work for isn't doing very well...)

I have filled out the application and am sending these:

Form I-485, with two photographs attached; filing fees of $1010
FormG-325A
Copy of Birth Certificate
Copy of Passport with nonimmigrant visa
Medical Examination
Copy of Marriage Certificate
Copy of Mortgage Statement
Copy of I-94
Copy of I-140 Approval Notice

Copy of Spouse’s Birth Certificate
Copy of Spouse’s Passport
Copy of Spouse’s Green Card
Copy of Spouse’s I-94
Copy of Spouse’s I-140 Approval Notice

Is this ok? Do I also need an affidavit? If so which one? ANY HELP ANYONE CAN GIVE ME WILL BE REALLY APPRECIATED, I'm starting to feel sick about the whole thing.

THANK YOU

Here is a link you might find helpful, I hope you have word Please let me know if this helped. This is just a list of things you would need just go through it. But before you do anything wait until more members give their input, as I'm not sure about you filing without a 1-130.

If your husband recently got his green card less than 180 days ago and you were married while his application was pending then you could file with the forms you listed. If this is not case, you will need to file I-130 and wait for it to be approved before you can submit I-485.

O thank you so much, that was the info I was not sure about.

485 - I don't think i need an I-130

The lawyers i spoke with said i don't need an I-130 ~ that i could just do a 485. are they wrong then? i was also doing an I-134. my husband has just got a new job.... i hope that will not be a problem as he got his green card from the previous employer

most likely, you are doing a following-to-join and may need another form (I-824, but check that first). You may also need to wait till his EB category is current again, if it is no longer current. You may want to read up on a sticky subject on following-to-join in this forum, and do a special search on FTJ benefits and employment based visas. Also check in the employment based GCs subforum.

You definitely don't need I-130.
