I-485 submission

I just heard from my Lawyer that the I-140 was accepted but the I-485 was returned on the basis that the immigrant Visa numbers for this year are finished and hence he will resubmit in October, can anyone confirm if indeed this is true.

it is true if EB3

I dont think you can file 485 if you are in the EB3 category. There are no visas till oct' 01. You can apply for 485 in Oct if your Priority date is current.

If you are not in EB3 then they should have accepted your 485 application.

If you are EB3 (excluding schedule A), then yes, Visa numbers are not available and you cannot file 485 atleast untill Oct. After that, it depends upon your priority date.

When did your lawyer sent the I-140 & I-485 applications to VSC? DO you have any idea when VSC has received your applications?
