I-485 status--USCIS mess up-HELP plzz

Dear forum members,

I ahd spoken to TSC last week and the IO who answered the phone, told em that my I-485 was tied to my EB2-NIW instead of my EB1, and after she placed me on hold for 10 minutes, she told me that my case had been sent to a supervisor, since every thing else was cleared (including NC and BC).

I recd a letter from USCIS yesterday (I had opened a SR in december) and the letter states---"The processing of the I-485 is ON HOLD, since the prioriity date on your I-140 is not CURRENT and no visa numbers are available"

It appears that they have CLEARLY up my EB2 I-140 to the I-485 instead of my EB1 I-140.

Further, I had an infopass appointment at Atlanta today and the IO was extremely unhelpful---she said that USCIS would eventually tie the cases up.......whatever that means.
However, she did clearly confirm that my name check and background check were cleared way back in september.


GURUS.......

How can I ensure that they will tie uo the EB1 and the I-485? This process is so frustrating--they have ano accountablility whatsoever.

There is absolutely no way that we can know whether they have tied it or going to tie. Several people have faced the problem. Either you can keep on pounding them with letter asking them to interlink or file another(ofcourse it would create a confusion,but alteast you are sure that you have a 485). How did you file 485 on March when there was no visa numbers for EB2.!!!!
 
I filed I-485 along with my EB1 I-140. I also filed EB2 I-140 NIW at the same time. But it appears that since the EB2 got approved first (without any RFE), they tied it up with the 485.
My EB1 was approved in June after an RFE

Send a fax to TSC asking them to interlink your case. send the same via email (pp email) to TSC since you got your eb-1a 140 approved under pp. Might work. who knows???

hi desi_doc_gc,
what you did for your case? did you send any fax or any letter. Looks like I do have same problems now. Please let me know if you get any response.

My lawyer has faxed the expedite rquest to TSC to interlink the I-485 and the I-140 EB1.
I do not know the fax number.
Further, I called TSC using the POJ method and they again reaffrimed everything. Yes, your EB1 I-140 is approved, Yes- your NC/BC is cleared, Yes all the petitions have the same A number---but we have you as EB2. It is so frustrating.
The IO howver told me that she has notified her supervisor and that the cases will be interlinked in a few months !!!!!!!!!!!!!!!!!!

I have also sent the USCIS ombudsman and my area senator requesting them to follow up on this mixup.

Hope something or the other works..........

It is terribly frustrating to know that despite my NC/BC clearing...this mixup is holding it up.

yes, USCIS is very frustating. I am also trying same thing.
lets us hope for good through fight fight fight!!
