I-485 Rfe--need Help

Hello Friends,
I need ur valuable suggestions:

My case is EB3 CONCURRENT FILING
JULY 18TH 2003-I140/485

FIRST EAD/AP--AUG 2003
:confused:
EMPLOYER SENT WITHDRAW LETTER TO INS JULY 4TH2004 AND I SENT AC-21 LETTER JULY 10TH 2004 STILL I GOT RFE FOR MY EDUCATION AND W2 OCT 2003(HAD A DEAL WITH EX-EMPLOYER) AND MADE HIM ANSWER THE QUERY AND I-140 GOT APPROVED ON DEC 2004 AND AFTER ONE MONTH INS REVOKED THE I-140 AND ISSUED RFE FOR ME ON MY I-485 EVL/AND PAYSTUBS AND MARRIAGE CERTIFICATE FOR MY WIFE

WE HAVE RESPONDED TO THE QUERY WITH NEW EMPLOYER LETTER/PAYSTUBS ETC.... ANY VALUABLE SUGGESTIONS :mad:

Hi Salam73,
I had the similar situation before. I think your case should be fine since INS has issued RFE and if you submit all documents INS need by using AC21, your case can be approved.
In my opinion, issue you RFE is better than you get NOID.... so once they review your RFE document, you and your wife can get 485 approved pretty soon.
Both of I and my wife 485s got approved at the same time ( 2 weeks ago), although we don't have RFE on 485, my 140 was revoked a week later after 140 approved like yours. Since our case got approved, your cases should be no problem.
 
Dont panic... there are posts in this forum by some one from an attorney's office that it is ok if the I-140 is revoked after you change your employment. I dont remember though if your AC21 should reach USCIS before Employer's withdraw request.

I would think that USCIS wouldnt harm your i-485 if your I-140 was revoked after you actually started working for the new employer. but I am not an expert and i could be wrong.
