I-485 RFE for I612 approval notice

I have an urgent case: I-485 RFE for I-612 approval notice. I have the receipt notice of I-612 and DOS recommendation letter, but, because
the I-612 processing time lag. How can I push INS to expedite my I-612 case? Please give me points. If I can not supplement the I-612 approval
notice before the deadline of I485 RFE, and just give INS the I612
receipt notice plus DOS recom. letter, what will happen to my I-485
finally? Thanks.

I will be in the same situation. Would you please share your data?
Did you apply for I-485 with the receipt notice of I-612 and DOS recommendation letter?
My data is the following:
EB1, China, I485 ND (01/09/01), FP (03/03), pending.
J waiver: Date for DOS recommendation letter (09/29/00), I-612 ND (10/23), No final approval from CSC yet.

We have had a dicussion of this topic the other days. In all,
your AOS will not be approved until CSC sees the final waiver
notice.

Since they are the one that is holding up both of your waiver
and AOS, reply the RFE with the receipt along with the recommendation
letter. I suspect they will approve your waiver shortly and then
AOS right after that.

Hi, Jerrychen, Did your I-485 package include the DOS recomm letter and the I-612 notice when you submit your I-485 to INS? If not, sending these stuff as RFE may be useful. Could you please post a detail information of your case.

Dear Ciba: Thank you for your points. The question is: If the CSC already has the DOS letter and the I612 receipt notice, but they still sent such a RFE, how should the applicant respond?

Johnson,

It does not matter whether CSC has the recommendation letter and
I-612 notice, they expect applicants to provide evertying! Their
computer/file sorting system are not that "smart" yet.

Reply the RFE with the notice along with the recommendation letter,
and you will be fine.

Hi Johnson,

I have no practical way to suggest on how to expedite processing
of the final waiver. CSC is doing things on its own. It took
them more than six months to approve my waiver. I suspect that
once you reply RFE with the receipt and the recommendation letter,
they will approve the final waiver shortly (because they have to
do this step before approving your AOS).

Hi Dimpu,

I-612 is application to waive foreign residence requirement
imposted on most of J1 visa holders. It can be quite a
hassle to go through the whole waiver process.

Accurately to say, I just received my FRE yesterday (previously discussion based on AVM). My RFE requests for I612 approval notice OR no-objection letter. Now, I don\'t have I612 approval notice, just have "the no-objection letter from my home country, DOS recommendation letter and I612 receipt notice". Because the FRE says \'or no-objection letter\', if I reply RFE immediately, do you think INS will approve my AOS without further FRE I612 approval notice? If no, what should I do now? hold the current FRE for some time to wait the final I612 notice? or still go ahead to reply INS? Please give me your comments.

Hi, Johnson Chen, I just wonder how you got "the no-objection letter from your home country". Normally, it was only sent to DOS. Then, DOS transfer the no-objection letter and data sheet to INS with the waiver recommendation letter. Please clarify. Thanks!

From waht you wrote, I think it will be OK to give INS either the I612 approval notice OR no-objection letter. Good luck!

Hi, csc: How do you think about the Johnson\'s RFE. He got the \'no objection\' letter which usually be sent to DOS directly from the embassy. If we receive this kind of RFE, do you think we are able to obtain the \'NO\' letter from the embassy? I guess the reason that our I612 have been delayed for so long time might be that INS loss the DOS documents including date sheet and no objection letter. But they should ask the \'No objection\' letter from DOS rather than from us. Do you know if people from other country can get their \'NO\' letter by self? I may contact with the embassy to see if they may sent me a \'NO\' copy.

Honestly, I do not know. If it really happens later, maybe we have to try to get a copy. One year ago, China Embassy usually sent a copy of "No" letter to the applicant. But later, they do not. They only inform by phone afetr it is sent to DOS.

Please let us know any progress.

Dear csc109: I\'m sorry to have made confusing. The letter I got was directly sent to myself, it stated that my waiver was approved by my home country and a no-objection letter had been submitted to US DOS. Not the \'no-objection letter\' itself, sorry about that. But, even this can prove no-objection letter was issued.

What\'s kind of \'NO\' letter you mean? That letter written in Chinese saying \'your case has been completed...., you were educated by homecountry and welcome back....\' or the real \'no objection\' letter that was sent to DOS. Are you sure that the applicant could obtain a copy of \'No" letter one year ago? my \'no\' letter was sent to DOS by embassy more then one year ago, but I didn\'t receive the copy. I was told that the letter is a goverment to goverment stuff....
