I-485 RFE for H4 visa

Hi guys,

I received an RFE (proof of stay in US).i came on h4 visa.
now i had all the proof from nov 1999till 2007 except for 2001..since we didn't apply for h4 as we were under impression that we don't need too and if h1 is approved that means h4 is valid too..
but then when my husband changed his parent company he came to know thru the lawyer that we have apply for h4 whenver h1 is applied.
now that i got an rfe for i485..i realize that i was staying illegal for atleast 1 year.i am not sure how my case will processed..will they baan me from staying is us?
pls help.

you need to post your details. when did your H4 expire, when ur hubby's H1 transfer was effective and when you applied for the H4 / H1 extension.


Check if there is any lapse in I-94 dates.


If you entered US again after the lapse you might be OK but it is debatable.
Few people say that if you are out of status then you need to leave USA &re-enter again.

if the gap is of less then 180 days then you shld be fine.

H4 approval notice date and VISA stamp dates dont match up. u shld have the first H4 stamp from around 12/8/1999.

also if you did not have the VISA stamp on your passport from 4/14/2001 to 7/17/2003 then how did travel out of USA in that period?
