I-485 Rejected, please help!

Thanks to everybody on this board. It's been a tremendous help to prepare for the green card applications.

My husband is a US Citizen. We mailed I-130, I-485, I-765 and I-131 in the same package to USCIS lockbox earlier this month. Hubby received the NOA for I-130 today. However, on the same day, I received the rejection notice for I-485, I-765 and I-131, along with all the related appliation material. On the rejection notice for 485, it reads " Based on the information you provided, your priority date could not be established.... The follwoing documents maby be provided: You original From I-130 if you are filing concurrently, or..., or a copy of your Form I-797 (Notice of Action) if the petion has already been filed/approved"

We are really suprised and upset about the rejection notice because we did file i130 and i485 concurrently, and every package was well organized. The only thing I can think of is that I did not include a copy of i130 in the i485 application since I thought uscic can just see the original 130 form right there. Do you guys always include a 130 copy for 485 application?

Anyway, we have to deal with the situation now. My questions are:
1. Since we received the NOA for I-130, can I just resubmit the 485 application and it'll be processed immediately after USCIS receives it, or
2. since the resubmitted 485 is not "concurrently" filed with I-130 and our I-130 is in pending status, we have to wait for the I-130 to be approved (easily a year from now) before USCIS can start to process my I-485?
3. If we resubmit the application, should we submit the application package returned back to us, or should we fill out new forms? Every page of the returned material has a line printed on its right edge, including a page number. However, the page number is differnt from the way I organized them, and mixed all the docs for I485, i765 and i131.

If anyone had similar experience, please share with us your knowledge. Your help is greatly appreciated.
 
Big duh.

You should have included a copy of the I-130 receipt or approval notice with the I-485 package... never ASSume.

Where did you send the files to? separate places?
 
Our I-130 and I-485 were sent to the same Chicago lockbox in the same package. Since it was concurrent filing of both, we did not have I-130 receipt, or NOA at the time. The check for I-130 was cahsed out 5 days after the package was delivered to Chicago. Would you please give me some insights on the quesions in the original post? Many thanks.
 
Did you write a cover letter explaining everything you submit in order? You need to write a cover letter when you put too many forms in one package. Just sent it back asap, make a cover letter.

Me, too! I filed concurrently and recieved NOA for 130 only but unlike you, my rejected 485 came back after 3wks! with the same message, file concurrently or with receipt.

I just filed back 485 with NOA copy for 130 with a letter explaining the same. So, I am a July 130 and Aug 485 filer.

this is a simple case of USCIS stupidity...just put a front paper explaing what are you including there, there is really no need of it but you deal with all kind of ppl there... you can put sticker tabs on every form so they know it's all there.
