I-485 rejected by VSC - Pls read this

Folks,

I-485/EAD/AP was filed concurrently based on pending I-140 application filed on Aug, 2003. At the time of filing I-1485 the I-140 receipt notice was not available.

VSC has returned the application twice stating that their "records do not show that you are the beneficiary of a pending or approved immigrant visa petition which would make a visa immediately available".

I just happend to receive I-140 filing receipt notice and have resubmitted the application to BCIS this time along with a copy of I-140 receipt notice.

Has anyone been in this situation?

Correct me if i am wrong, but as i understand, there are two ways of filing I140/I485 concurrently.

1. Put both applications in the same packet.
2. Attach the receipt notice of (pending) I140 to the I485 application. ( So one must wait for the receipt notice from INS before sending I485)

I the case discussed above, no copy of the I140 Receipt was made available. Thus BCIS could not accecpt the I485. I feel once the receipt is attached, and the packet is resent, it should be just fine.
