I-485 Receipt & H1 6yrs expiring

Hello,
Here is my situation:My H1b nearing 6 years by july 04.My wife had applied for GC and her I-140 got approved.Now we are going to file for I-485,EAD/AP in May 04.After getting the receipt for I-485,I know that it takes us atleast 90 days to get our EAD.

Now it may be possible that after my H1b expires in July and I may not have EAD in hand(will have just the I-485 receipt),then will I be in a legal status?

------- you will be in legal status after I-485 filing and your status will be AOS pending but you can start work only after you get EAD. If possible request the lawyer to file I-140 for your spouse, I-485, EAD AP (for both of you) ASAP
