I-485 Questions (EB2-NIW)

I just got my self-petitioning NIW case approved by VSC, have several questions about I-485 filing. Gurus on the boards, I will appreciate if you can help me with your knownledge. Thanks!

1) On Form I-485, there is an item called A#, what is it? and where do I find it? Or the A# will be sent to me soon and I can file the case after I get the A#?

2) where should I file I-485? Local INS office of VSC?

3) Affidavit support/Employment letter? Since it is a self-petitioning NIW, there is no employer invovled, do I still need an employment letter? My spouse would file I-485 concurrently with my I-485, should I submit Affidavit of support for him/her?

4)medical exam, where can I find a list of INS approved doctors for the medical exam?

5)Concurrent filing, Does it mean I should send my I-485 and my spouse\'s I-485 in same package?

6)Evidence of status, is it copy of the current Form I-94 or copies of all the documents for my F-1, EAD and current H-1B?

7)Should adavced parole and work authorization application be filed and sent in the same package of I-485 filing or should they be filed and sent to INS sepetratly?

I guess I have too many naive/stupid questions. Thanks for any hints or answers, thank you very much.

Since I just went through the whole NIW I-140 filing, I would be glad to answer if anyone would have any question in his/her NIW filing.
 
A few suggestions

Hi:
I did my 485 stage without an attorney too though under EB1 OR.
Here are a few thoughts of mine. You may want to cross check with other sources.

1) Your A# can be found on your approval notice of I 140 or worst case in your OPT if you have one.
2) You need to file your I 485 at VSC if you are still in the same place.
3) I dont believe you need an employment letter since you are filing under NIW. Other than affidavit of support, I would also furnish a copy of the marriage certificate.
4) There are a number of websites which list the doctors approved by INS for the medical exam. You should be able to find one based on a search. Worst case scenario, you can get such a list from the local INS office.
5) Yes. Clip all your files together and do the same for hers. So it is clear that these are two different people\'s documents. Put them in the same package and send them over to VSC.
6) While you are required (imho) to submit just the latest I 94. I would go ahead and submit everything I have just to be safe.
7) You can send them in the same package with a cover letter that explains things you have applied for and the total check you are sending them. If you are not planning on using the EAD or AP then you may defer the same. To be on the safe side again, it is advisable to file all three together (God knows how long it is going to take).

Thanks a lot for your detailed answers to my questions, which make me much more confident on filing the I-485 myself. Your help is highly appreciated here.

I have one more question about the A#, I do not have one on my I-140 approval notice, but I have one on my EAD card, is this the right one? As for my spouse, she even do not have an EAD card since she never had her OPT, what number should be filled on her I-485?

For clarification, is A# what so called immigration Number or they are totally seperate?

You SHOULD have an A# on your I 140 approval. In all likelihood that would be the same number on your EAD card too, so you need not worry. In my wife\'s case we used the number of her OPT I think. If your wife does not have one, a fair guess would be to leave it blank because everyone is assigned an A # at some stage and since she would be a beneficiary on your application, she is not likely to have an A# by herself as she does not figure at the 140 stage.

I am not sure what an immigration number is. A# is also called Alien #.

A#, File Number (A-), and Alien Registration Number are similar if they are not the same one.

My lawyer said he will not fill any A# for my i-485 application because A# is for green card holders. Your A# from your i-140 approval notice will be changed after you get your plastic card. I am not sure if we will keep a single A# through the whole damn process without any change.
 
One More Question

last year I went to Canada and applied the H1-B visa from US consulate there. The visa is not used when I got back in US through the us-canada border.

My question is: there are several entries on I-485, namely, Last arrival date, last entry place, etc., Should I provide the information of the above entry or previous entry from other country than Canada.

employment letter

Hi, I have some thoughts about the employment letter for NIW for your reference. Anybody corrects me if I am wrong.

The NIW is still employment-based application. There is no reason to avoid the employment letter for I-485 adjust status. But employment may mean differently in this case. The petition based on NIW only means that the job is deemed in the national interest of the United States. So it could waive the job offer. The employment letter in the I-485 stage for NIW case could mean that 1) you still work in the area of national interest. You don\'t have to be hired by somebody else but you still work for the field of national interest. If you are a full-time student you still can prove that you do research in the area of national interest. 2) the employment letter may be just another way to show that you have income. You won\'t become a public charge or depend on welfare. If you are student with assistantship you could show that you legally work and you get paid.

I would suggest you to consult a lawyer and then make decision whether or not to have an employment letter in your package.

A# on I-140 approval notice

Everyboday suggests that there is an A# on I-140 approavl notice, but I do not have one. Is it only my case or normal?
