I-485 question

Hi,

I'm currently in US on H1 status. I'm married to a GC holder and I just got my I-130 approved. The priority date in my I130 petition is Sep 07.

My question is can I apply for I-485 (adjustment of status) and I-765 (EAD) right now or should I wait for the priority date to be current? In the letter it says that I can apply for I-485.

Even if I have to wait (till my priority date) for I-485 to be processed will my EAD be awarded immediately?

You can apply for I-485, once your priority date is current, assuming you remain in legal status at that point. Doing so sooner will result in your I-485 being rejected.

I am not sure applying for I-485 with a spouse on GC (maybe I am wrong)...wait till your spouse is US citizen - that will be much easier.
