I-485 Question

My AP expires on 5/27/04. I am currently outside US(In Bangalore) on a temporary assignment and want to return to US and file for the renewal of AP.

I have already updated USCIS with change of address to my friend's address in US.

Is it really needed for me to stay in US until I get my AP approved?

Given my current situation, I will have to come to back to India(after applying for AP renewal) to continue my assignment. I intend to return back to US after my assignment ends which should roughly be the end of this year.

Since I have given my friend's address to USCIS, they will send the AP approval to my friend right? So, why should I stay until the approval happens?

Anybody who have been outside US during their AP approval?

The USCIS website does say the following but please note that I will be leaving US before my current AP expires. So, is it safe to assume that the rule below if only if you do not have a valid AP at the time you leave US?

Aliens applying for advance parole on the basis of a pending application for adjustment of status must be approved for advance parole prior to leaving the United States in order to avoid the termination of their pending application for adjustment

Please help.

Ur current AP expires on 5/27, so u can apply in US and go back to India now. But if ur new AP is not approved before 5/27, u will have to come back to US before 5/27 and wait till its approved.
I think the reason for the INS rule is that they want to make sure u r still interested in GC and not leaving US for good. They do not want to waste time on processing AOS for applicants who r no longer interested in getting GC.
 
I thought that if you do an address change, in most of the cases RFE is issued before approving 1-485 to prove the proof of residence. Since you provided the address of a friend, how are you going to prove the proof of residence (electric bill/phone bill) ? just wondering.... since couple of my friends are thinking on the same scenerio.

When will be asked for proof of address? As long as we can access the mails, it is ok isnt it? <baring PO boxes>. I use a c/o address of my cousin.

INS allows two addresses on record, one for your address, and another for mailing address. This is the first I have heard of RFE's because of changing residence. People use 2 addresses ALL the time. In fact for me my mailing address is my lawyer's office since that is pretty much permanent and I can change my residence any number of times without worrying too much about INS keeping track of my addresses to mail my documents.
