Hi, I'm preparing my I-485 (family based) and need your advice on how to answer this following question:

Have you ever been under immigration proceedings"?

Answer: No___ Yes___ (If yes, then Where___ When___)

Removal___ Exclusion___ Recession___ Judicial Proceedings___

My situation is that I started labor (employment based) applications in Apr. 2003. Labor got approved Nov. 2005 and filed I-140 Dec. 2005. I-140 was approved Jan. 2006 according to my attorney but was not received by my manager (petitioner) yet.

How shall I answer this above question? When asked "where and when", do I put in my state where I started my labor certification or where I filed I-140?

Your advice is greatly appreciated.

That question has to do with having entered illegally or having committed fraud or other crimes that lead to your removal from the US or something similar. Sounds like it doesn't concern you, so just check "no". :)

thanks so much!!

unbelievable ...i just don't get all those confusing terms...thanks so much!!

Right, it does not concern you. I was "subject to removal" once, and I still needed to say "No" on the application. Only if you were odered to be removed/deported - then you say "yes".
