I-485 Question - GC for spouse - Gurus please help

Hi All,

I am soon to become a US Citizen. I will then flle for my wife who is currently in the US and out of status. Everybody has been telling me that her status should not affect the application since she is married to a USC. When reading the instructions for the I-484, I found the below(in bold).

"You are not eligible for adjustment of status if any of the following apply to you:

A. You entered the United States in transit without a visa;
B. You entered the United States as a nonimmigrant crewman;
You may apply for permanent residence if you have continuously resided in the United States since before January 1, 1972. This is known as "Registry."

C. You were not admitted or paroled following inspection by an immigration officer;
D. Your authorized stay expired before you filed this application;" :confused:

Can someone please clarify or help me understand. Does this statement apply to a an out of status spouse of a US Citizen???

It does not apply.

Immediate Relatives of US Citizens are pardoned any overstay/illegal employment (for as long as they admit it) and that would be the case of your wife. She is fine.
 
Brother, no offense, but you don't need to start a new thread for each of your questions. You have a better chance to get all of your questions answered if you just stick to one thread.
