I-485 Query

Hi there:
I am just about at the stage of filing my 140 and I-485applications.

I had one issue 5.5 years ago, I was arrested for a harassment charge and conditionally discharged. There was no criminal record, and this happened while i was living in Canada. I do not have any record in the US, but was concerned if this could effect my I-485, etc.


I did read some posts from people that had misdemeanor arrests and still got their green cards. If anyone has experiences or knows this could cause problems, I would like to know upfront. I have never had issues get US visa(H-1) with this info on my application.

As long as your PCC for canada or india are normal, you should be in good shape.

But this is something you should consult an attorney with!

PCC = Police Clearance Certificate. It is a basically a police clearance that BCIS requires before one can get GC approval. But due to the nature of the incident i would recommend 485 ...do not venture into consular process for sure.

If I were you I would apply to a canadian consulate for a PCC and see if you get a police clearance. REsearch this site to find out how one gets canadian PCC. Or search on yahoo.com for canadian consulates in usa.

FYI...this is a consular process thread and you may get correct answers if you post 485 questions in 485 thread.

Can anyone refer me a good indian criminal immigration lawyer. I need to consult a lawyer on a issue for which I was arrested. I am at the I140/I485 stage, and my current company immigration lawyer wants to get another opinion on this issue for I was arrested. I hope to find a rather inexpensive lawyer if possible.

You do not need a criminal lawyer for this. You could consult Rajiv Khanna directly as he is one of the best immigration lawyers in usa.

This conversation can be done over the phone...you don't need a attorney to be in boston. Needless o say before your cnversation you may want to have the papers around the exact charges that were filed and the exact verbiage on the case to get an accurate answer from any attorney.
