I-485 Problem with tax Returns and W-2....Please help

Hi All
My I-140 got approved yesterday (did NOT apply for I-485)

Getting ready to apply for I-485
Question: Everything is fine except that I worked only 3 months EACH in 2002 and 2003 and my W-2 amounts for these 2 years are very very low

My attorney is asking for copies of last 3 yrs of tax returns and
W-2 forms

I am afraid what will happen to my I-485???
How important are the tax returns and W-2 forms at I-485 stage

Note: I already submitted 3 years tax returns and W-2s from 1999, 2000 and 2001 when I applied for I-140


Please advise me.

They're not unless USCIS asks for them. Don't give them what they don't ask for - especially if those W-2s and tax returns provoke more questions than they answer.
 
I agree. However, even if your W-2 amounts were small, chances are you still should have filed a return. If it is not a big deal, I would take your information to a local tax person and get them to run returns for you.

If you do have to file for those years, chances are that amounts due will be minimal. If it turns out you didn't have to file, you have the peace of mind that it will not be a problem at the I-485 stage.

I don't think this is a case of non-filing, just a situation where the tax returns and W-2s show suspiciously low income based on very little time spent working.
 
I see. To be honest, I used to work in this area but left because the rules were just far too complicated! :)

TheRealCanadian - are you in this business? You seem to know more about it than most folks here. If so, good luck with tax season!!
 
485 concerns only with not working illegally. So low tax return should not matter. There is always the issue why were you not working- do you have a permanent job etc- with low tax returns some eye brows get raised. But if you have a permanent job now with a company that has ability to pay- you should be good.
