I-485 Priority Dates - NEED HELP

Hi Friends,

I have question about priority dtaes.

My old Priority date is Jan 1999, with that both my Labor and I-140 was cleared. That time I was waiting for my Priority date to become current. Unfortunately I lost the job.

With my new employer again I applied for GC and now I am at I-485 stage. I filed my I-485 in March 2003.

My question is:
1. Can I use my old priority date now??
2. If so, what is the benifit? Does my Process will speed up?
3. What I have to ask my Attonery to change my Priority date?

I have copies of my OLD LABOR and I-140 approvals.

Is your new job same or simillar to the one mentioned on the old labor?

Is your old 485 still in the system or has it been withdrawn?

Has your old employer withdrawn your old 140?

if you answer yes to first and no to the second, then you can try using AC21. This way you can keep the old priority date, and so your GC can be approved very shortly.

However, I can't help but wonder if USCIS has already taken an action on your old 485 or not, because it is clearly a long time ago. Have they considered your old 485 abondoned?

Talk to your lawyer. I would try my best to use the older 485. I also don't know what are the ramifications for filling a new 485 with the new labor and then trying to switch to AC21 with the old labor. I know that a person can file multiple 485s (so I have read and heard)

He indicates that he lost his job and sponsorship before his priority date became current. Therefore, no I-485 was ever filed.

1.You can use Old PD if the dates were not current. Since the dates are current no use.
2. Again No befits since the dates are current.
3. I think you need to send your old I-140 approval notice, which has your PD. I do not see any advantage in using old PD as of now.
