I-485 Preadjudication

Hi,

I am from China. My 485 was concurrently filed in December 2004 (lucky me). My priority date is June 2002. I've heard that they've started the preadjudication since many months ago, and some people have already got preapproved. But mine is still sitting there with LUD of April 2006. Does anyone have an idea what could possibly be going on?

What do u mean by preadjudication ?

If u filed in Dec. 2004 and ur LUD shows 2006 that means it's being actively worked on. So why do u worry. wait for ur PD to be current.
 
I do not belive that service centers are pre-adjudicating any 485s during visa unavailabilty period, except sending finger print notices thro automated system. One guy mentioned here that,, even they are going to stop sending FP notices while visa unavailabilty period.

The reason for my statement is, I received a letter from USCIS (NSC), regarding my address change. In that letter they mentioned that my I-485 file will be processed only after visa numbers available for my periority date.

Answer to question from hkhr. Before this preadjudication thing, everyone has to wait for his PD become current before his 485 case is processed. The preadjudication=process without waiting for the PD become current. However, according to AGC4ME, we still need to wait for the PD become current until the case can be approved.

To the best of my knowledge (from NSC I485 forums), a lot of people are getting RFEs as part of the pre-adjudication process ( even throught PD is not current and in fact, far from being current). This started after NSC announced their pre-adjudication policy.

However, it seems that its just a way for NSC to do some clean up, weed out any applications that are no longer valid and keep their records updated, so that down the line when PDs become current, they can adjudicate quickly.

Thats seems to be the intent anyways, you never know what will happen in reality. if its further going to take 3 years for PD to be current (for those who got RFE now), they might as well send another RFE that time asking for latest EVL letter and such.

it goes back into storage. EAD and AP will be processed though. Many 2003\2004 I485 filers are in that stage.
 
you will continue to get EAD (work authorization) and AP if you have applied for 485. USCIS has clarified this.

got the receipt today. and it was current when they got it. when wil i know if they will place the i-485 on hold? thank you.
 
When your PD is no longer current, they wont look at your file (ideally) except for processing EAD and AP.

what application? The bulletin that comes out every month mentions the cut off point effective 1st of coming month (e.g. bulletin for July comes out in mid June). So if your PD is current and the bulletin says next months its going back next month and your PD will no longer be current, then rush your appliation this month when it is still current.
 
The preadjudication is for real. I got my I-485 RFE. My PD is April 2002 ROW.

avi- turns out i could have put in application since may. i was waiting for letter from nvc. then the bulletin came out and i went mad and not a person wanted to help me. even the person who did the i-485 was angry at me for pushing the issue and was telling me that i could send in the things like next week. anyway, i sent in the things and now must wait. but i am in.
