I-485 pending and H-1B application

Hi!

My I485 has been pending in VSC for 26 months. My third EAD has been pending for 60 days. And the second FP was scheduled next week.

My current O-1 visa will be expired in MId-Feb. 2004. I am plannng to ask my company to apply for a new H-1B visa, in case, no luck for my I-485.

My immigration case is EB11 without sponsor and I140 was approved in 10/2001.

Would anyone please answer two questions to me?

(1) Can I apply for H-1B visa when I have a I-485 is pending in INS?

(2) Is it neccessary for me to apply for 1 new H-1B now?

Contacted local congressman twice.

sure you can apply for H1

My company filled it last week though my I-485 is pending from past 2 years
 
My first question would be is O1 is valid once I-485 is approved? Check with attorney. Because only H and L visa enjoy this dual intent.
 
I use EAD, can I apply for H1 also?

I am in the similar situation. I use EAD, now, can I apply for H1 instead of keeping renewing EAD?
