I-485 Orlando DO not approved. Missing I-130 file

I am so frustrated! My husband applied for my Green Card 8 years ago. In November 1998 my I-130 got approved. Today I had my Interview at the Orlando DO. The officer told me right away that he can’t approve my I-485 because they are missing my original I-130 Petition from 1998. He can’t do anything about it. If they can’t find it I will have to wait 120 days and they will schedule me for a new interview. My ND is 01/04/2004. I am waiting now for 2 years and 2 months. I am exhausted. I feel helpless and empty. The officer was very nice and apologizing all the time. But said there is nothing he can do about it. He is only temporarily working at the Orlando DO to help them reducing their backlog. I was telling him that I do have the approval of the I-130. But this is not enough. They need the original application. I was crying all the way home. I haven’t been in my home country for 6 years. I planned going there in June…

But I don't understand even you having the original approval letter he said that it wasn't enough? I don't understand?
By the way, I thought that ATL was slow but OMG why so long? your husband was a GC holder before?...

Hanging there dear, but what the officer told you? I mean the system should said that is really approved! so what they going to do if they don't find it??? Your husband con submitt another one?

Yes, my husband was a Green Card holder before he naturalized in February 2003. So I had to wait untill my Priority Date came up. I didn't understand either why they couldn't accept my original I-130 approval. They need the Original Form I-130 Petition from 1998 that we sent to Texas. I know, it doesn't make since. And I never heard about a situation like this before. But I think the USCIS Devil is sitting over me. :(

People sitting there have no clue how badly they are affecting ppl's life. So many can not meet their loved once because USCIS LOST their file. So many can not go ahead with their future plan because some lazy a$$ is just sitting on file and doing nthing.
I am so sorry for your situation.

Amishah, no word on your FBI name check?

I thought the file of I-130 was put together with the I-485? it was like that in my file...
I mean if they accepted your file, they had once right?

No. I am not expecting anything tilll atleast 6 months. Specially when my DO has nothing to do with online status. My online status is same as it was when they first received my application. We have file for renewal of EAD and we have FP appointment on 4th of April. Hopefully I will be able to find out about when they started my FBI check and if they need anything on that ticket that my husband received. Atleast that court thingy should be done.
I am trying to concentrate on other important part of my life. I am running behind by 1.5 years because of these stupid people.

fanta1, im sad and sorry to hear that, but dont worry. This is not the first time this thing has happened, there were other applicants who posted a similar experience in this forum and as per their experience, it took USCIS 30 - 60 days to recover the file and approve their GC.

Take a break, distract yourself for a while and compose your strength and energy and then charge right on USCIS and stay on their heads till they find your file. I hope you got the contact info of the officer who interviewed you, and if you did, call him atleast once every week and keep tabs on the progress. Good luck and dont worry.

While you wait, you can gather information of your congressman and be ready to approach them if USCIS drags your case.

Thanks to everybody in this forum. Without you buddies I would be even more frustrated. My life is now on hold for a long time. 3 Years ago my son aged out and i went through hell with the USCIS. (From E-2 Visa to V-3 Visa to F1 Visa) Finally he got his Green Card approved before me. (August 2005)The reason was that he moved to Austin, TX. The San Antonio DO rocks!! It took them 70 days to approve his case. They where very friendly! I never overstayed. Did everything by the books. And still waiting...On the other hand I really have to say that the officer was very nice. He tried everything to explain the situation to me. He even gave me his Phone# and X#. I don't know if he is able to find the file. I can only pray!

In fact you can apply for AP if you've never overstayed.
 
Hi, my friends:

After an exhausting night I called the NVC today. They told me that my I-131 file got transfered to the National Record Center in Missouri in August 2005. So I called my INS Officer today and informed him about that. He said they allready requested my I-130 but he can't promise when they will get it. Just to ease all other minds in this forum. This just happened to me because my husband was Permanent Resident while he applied for my Green Card 8 years ago. If your US-Citizen spouses applied for you, you send all the petions together.(i-130, i-485,...) When your spouse is a Permanent Resident you have to wait for your Priority Date, So you file I-130 first and after your priority date is current (It took me 6 years) you can finaly send in your I-485. So I am waiting 8 years now!!!!

Does anybody has a clue if I can get the phone# of the National Record Center?

I am so sorry for your situation and wish you best of luck.
You know, even thought my husband is USC I didn’t file I-130 and I-485 together…I submitted I-130 to TSC and after it was approved I filed I-485 with an approval notice. Everything went OK.
It is so unfair what they done you! Like after 8 years they couldn’t look in your folder and figure out I-130 file is missing before calling you on the interview?!! :mad:

i wish you good luck! does a usc who filed an I-129f need to file I-130 after fiance enters country and gets married?
