I-485 marriage based denied..possibility to reapply? please help...

Latest update...I received email from my lawyer today (5/1/06). He said that he got the notice from local CIS that they accepted our motion to reopen and grant us until June 10 to provide the eveidence with the writting notice from DOS. ....now on DOS website, I see that they send out the notice that I'm not subject to 2 years HRR since April 18, but I still haven't received anything in the mail yet. Anyway, I hope it'll come soon. But at least now I'm releived that my case is reopened. :)

I just want to give you my last update and hope that my tory can help someone in one day. I finally had another interview two weeks ago and I just got my greencard today. Here's the summary of timeline about my case......

12/06/05 summited application I-130 and I-485
12/12/05 got receipt notice from USCIS
mid 01/06 received interview appointment
02/21/06 interviewed --- USCIS approved I-130 but denied I-485
because of 2 Years HRR rule
02/23/06 met with a lawyer to reslove problem
02/28/06 lawyer sent a request to DOS for advisory opinion
04/02/06 deadline for MTR with USCIS but we didn't have more
evidence from DOS yet, so we let it ran out
04/07/06 received online notice from DOS that I'm NOT subject to the rule
04/10/06 rushed to file appeal with USCIS with reason why we filed MTR
after the deadline and paid $385 for MTR
end of 04/06 USCIS gave a notice that the case was then reopen
and gave us until June 10, 06 to provide them with written
notice from DOS
Mid 05/06 recived written notcie from DOS
05/26/06 USCIS sent out fingerprint notice
05/31/06 received 2nd interview notice
06/09/06 fingerprint done
06/14/06 2nd interview done
06/27/06 received greencard........hooray :D

Anyway.....thanks for all your help. It's nice that I could have someone to share info here throughout my case. Good luck to you all.

You can reaply I belive, but in any case you need to hire a really good lawer.
Most likely it is going to take a long time. I have a friend that had the same situation as you, it took her 5 years to get her first interview. They had a very good lawer too. About your overstay it will be forgiven, especcially if it is not more then 180 days. I think you need a good reason to stay....
My other friend had to leave for 2 years and got everything straiten out a lot quicker.
