I-485 is approved 09/16/2005

Dear All,

I wanted to share the good news with you that our I-485 applications
have been approved today 16th September 2005. We received two
emails at 9:31 PST from USCIS about the approval. Online message
has changed to confirm that our cases are approved.

Quite frankly, I was excited only for few minutesbut the excitement wore
away fast.

I want to thank each and everyone on this forum for being with me
throughthis journey. I can't even remember all user-ids I came
in touch with and discussed my pains and got relief. I am planning to
hang around this forum a while and try to share my experience. Please

Thanks to Rajeev Khanna for hosting this website. I can't imagine
how little I would have known without it. Best wishes to you.

People out there who have cleared there name check MUST email CSC-XII.485
(mention in subject that name check is cleared) and ask them to expedite
the processing. It worked for me. Mr. James A Williams, responded quickly
and assured to process our cases within a week. Indeed they approved it
in three days after my email.

Finally, I sincerely hope and pray that this retrogression doesn't seem
to be as bad as it seems. I am sure it won't last long, so please hang
in there. If you ever feel a need to discuss your case please email
me !

I'd like to say just one last thing before signing off
fight ! fight ! fight ! for your case.
Govt agenencies in this country are no different with their pace
from what you may experience in your home countries. Maybe just a little
bit better (?). It's your case, you have to take charge. Lawyers can

We (my family) have our I-485 pending now and worry about the retrogression. We have done our name check (according to congressman office, the FBI has forwarded the result to USCIS headquarter in July, 2005). But when we wrote email to CSC-II, the sir told us that the result is not available yet. I read your posts, and in one of them you mentioned that you inquired CSC-II after your name check was done and they replied "Let me try" (to us, the sir just said the result is not available). Did you do any other effort to make your name check results available asap? Since the retrogression is coming, we are trying to make our name check results be available asap. We really have no idea what we can do next. Any information, any suggestion, could be great help for us.

Do you know how long was your case in fbi name check? My dates are similar to yours.. but i believe mine is still in fbi name check, atleast the last time my lawyer checked 2.5 months ago...

I tink FBI sends results to USCIS Washington D.C. office, which
then makes it available to CSC. Most likely your results are already
with D.C. office but for some reason these results aren't visible to CSC.

Ask your congress person to make inquiry to D.C. office and make
them send the results to CSC ASAP. You need to convince your
congressperson about retrogression and request them to elicit required
results from USCIS.

I had attached FBI response to name check inquiry by my congress woman,
when I wrote emails to CSC. I guess you should do that too.

You better push CSC and USCIS D.C. office to make the results available.
Find out phone numbers of officials and call them. Fax them everyday.
Explain the retrogression situation. If FBI has already sent the results,
then there is no good reason for them NOT to process your case.

When I heard about retrogression, I was so desperate that I was
thinking of filing a lawsuit against USCIS to make them act on my case
before 1st of October 2005. Luckily I didn't have to go through that route.
Please search "writ of mandamus USCIS" on google ! A Decent lawyer
should know about this procedure so consult the lawyer for feasibility
and/or necessity in your case.

USCIS sent request to FBI for namecheck on 10th of August 2004.
FBI completed my wife's name check and returned results the same day.
For me, it took exactly one year (10th of August 2005) to complete name
check. But it was only after my congresswoman made an inquiry to FBI
on 4th August 2005. You should involve your congressperson (www.house.gov) or senators to query FBI. Senators office maybe bit
slow. You should be able to get better help from congressperson. Atleast
that's what helped me !

Have you received your 485 approval letters? My 485 was approved on 9/19 and I would like to get an idea of how long it will take to receive the approval letters. Also, is it necessary to do biometrics alongwith i-551 stamping before oct 1 to be free from retrogression.

Did you contact your congressman/senetor for FBI name check stuff? If yes, woould you mind sharing information regarding that..

Specifically, how did you contact them? mail and/or fax/phone call? Format of the letter would also be helpful..

Yes, my congressperson helped me resolve the namecheck. You have
to find epresentative from www.house.gov for your zipcode. call their
office, and ask for immigration case worker. talk to the person and explain
your situation. they will want you to send them a written request. after
which they should make inquiry to FBI.
 
Your are approved now. You don't have to worry about retrogression.
The new procedure for Getting the physical card have changed.
Most centers WILL NOT stamp your passport now unless there is an immediate need to travel. If needed they will send you a letter telling you to appear for Biometrics so they can make your Green Card. They will do pics, signature, index fingerprint. There is no need to book an infopass appointment. Just wait for your processing details. They will tell you what you need to do. I was caught between the new and the old system and we got our Biometric letters about 4 weeks after we got our pasports stamped. In our case we could ignore the Biometric letter since we had already done the processing needed.

Thanks for that info. Obviously you know this process quite well having
seem old and newer formalities.

So far we have received our 485 notices and today morning I made
an appointment for Biometric as per the notice.

Could you tell me when and where does

1) passport stamping (what kind of stamp).
2) temporary card
3) Physical card

come in play ? Can I consider myself a permanent resident after approval
of 485 for all legal purposes or do I have to wait till I get the card ?
 
Yes, you can consider yourself as permanent resident. The clock for citizenship (5 years) starts from the day of I-485 approval.
