i-485 interview over file pending with officer since 15 months NY office

I applied for my adj of status(i-485) at the New York office.My husband is a citizen by birth.We have been married since 7 years and have a baby . The date on the reciept from the ins is dec 2001. My finger prints were done in August 2003 and the interview was on dec 2003.I was asked to submit additional documents which i duly submitted on time. Its been 15 mths since my interview and have not recd any notification from the ins ever since.Despite several calls, writing to the ins and visits to the local ins office all i get to hear when i visit the office is that the case is pending with the immigration officer and its upto her to make a decision. is this a common procedure.The date on the uscis website for processing is applications dated august 2002 which is way past my application date.
Will an attorney be able to help or is there anything i can do to get a decison soon.I have entered the country legally with a valid visa. I am really fed up of this waiting. please help somebody..i will really appreciate all your suggestions...
 
Congressperson! Find your local congressperson online using your home address, and then go with your husband to their office. Take all documentation with you, have them start an inquiry. Ask your husband highlight that he is a citizen constitutent and let him do the talking.
 
This is the same damn problem of having Background name check pending. Bottom line is that if your passport is not stamped on the day of the interview, it will be an infinite wait. I am one of those victims.
 
Thanks for your prompt replies. I do intend meeting with the congressman and will update all of you on what happens next. I have already mailed letters to the senator etc but to no avail..lets see what happens next..romit how long have u been waiting? have you appointed an attorney? all the best to all of u

I suspect something got lost somewhere.

fyi to everyone

after your interview and they asked you for support documents they must respond one way or another within 120 days of the interview.

if still no word give them a call or fax.

if you still can't get anywhere call your congressman.
 
whats an i-89

does anyone know what an i-89 is please give me details.I was informed today by an immigration officer on the phone that there has been no request for an I-89 done ..i have to go back again to the local ins office and convey this message to them...does anyone know how long this process takes. please advise me i have managed to get an appointment to visit the ins office tomorrow. thank you for all your suggestions so far
 
thanks for your prompt reply but if you could help me with a few questions i woudl appreciate it. do you know how long it takes after this form I-89 is resubmitted for them to process or at least stamp my passport.i need to travel to india in may'05 and many people have adviced not to travel on advance parole. i am just hoping to at least get a stamp on my passport. do i need to carry photographs also to the local ins office thankyou

those who advised you not to travel on advance parole, did you tell you any reason? if they did, could you please tell me?

i did consult a lawyer who suggested not to travel unless theres an emergency( someone close in the family back home is sick). there have been a few people known to us who have been grilled on their return to the usa.no one i know has been refused entry but its just an endless ordeal dealing with them. all the best

no luck at the local office today. despite an infoapss aptmt a long wait all i was told is that calls do not get transfered to immigration officers on the 1800 nos. my case is still pending with the officer.
so folks in my personal opinion do not believe anything that is conveyed by the customer service nos not even if the call ever gets transfered to an immigration officer ( make sure u note down the name and location where the call has been transfered- mistakes i made ). i was told my wait for approval of i-485 can be anywhere from 2- 3 years and if i wish to travel outside the country i could apply for AP. Anyone with any good/ bad experiences travelled with AP pls share them so i know what to expect. so far i have only heard stories from friends abt being grilled by officers on return. thank you for your time

same old story

heres the recent news from my side...My husband as a USC has mailed strong letters to the senators , congressman so lets see if anyone helps.Meanwhile i was told by a close source at another ins office that security check does not take so long. if the officer decides to sit over a case( in my case shes probably sitting over a pile of files) theres not much anyone can do but just ask for help from the senators and they have helped in the past.You just have to be pushy and follow up. all the best to everyone going for an interview. meanwhile anyone recently travelled on AP pls share your stories. Thankyou

My wife came back to SFO airport on AP. They asked her date of birth and then asked her to go to another room. after going there, she handed over the passport and sat down for couple of minutes. the officer called her and gave her the passport and said, go through the custom.
 
security clearance

i have a question because its been 12 months already and did not received anything from immigration. i went there and asked about the status of my i485 and the officer just told me they cant do nothing about it because its up to washington already to approved the clearance and for my daughter for further review and she told me that her will take longer than the security clearance. can somebody give me advice about this one please
 
Give more details on your case to be able to others to help you.
Have you been interviewes, fingerprinted?
Have you applied for EAD and AP?
 
security clearance for adjustment of status. question please!!!!

I got interviewed already last march 2004 and got my ead and fingerprint 2004. i'm just waiting for the security clearance for them to stamp my passport and get a temporary gc. its already 1 year I did 'nt hear anything from them and I went to the office and one of the lady told they can't do nothing about it., its not up to them, she stated as long I have EAD i'm okey. please help what do I need to do? I did not apply for AP yet
