Hi All,

Just today we recieved an interview date for 9/1 for Newark office. My case details are:
Ind/EB3/NJ-Middlesex County
I140 - Oct 2003
I485 - Nov 2003
FP - July 04
Interview Date 9/1/04

Have a couple of questions may be some experienced folks can guide me on that.

1. My I140 is not yet approved. Will I have to wait for I-140 approval after the interview to clear the final stage or do I get approval the same day.
2. We have done a medical exam in Nov 2003. Should we take another medical exam before we go for interview. The interview letter does mention that we should bring the test results.
3. My address has changed, can I file the paperwork for address during the interview or does this have to be befor. Will that effect the application processing time.
4. Should I take a lawyer with me for interview. Is their a long wait at the Newwark office even though they give you an interview date. My lawyer is charging me $500 for first 3 hours and $200 every hour their after and he told me that usually it is 3-4 hours of wait before the interview. Does any once has experience in this area.
5. Do they stamp your passport on the same day? or do you just get an approval letter that day, if you get approved.

Any information from the readers is appreciated.

Thanks,

-K

--Same day, local office will approve I-140 and I-485
2. We have done a medical exam in Nov 2003. Should we take another medical exam before we go for interview. The interview letter does mention that we should bring the test results.
--no need, jadon mangaya nahin taan kayun ley key janna???
3. My address has changed,
-- you were supposed to file Form AR11 within 10 days of moving, if not sent file ASAP
can I file the paperwork for address during the interview or does this have to be befor. Will that effect the application processing time.
----- send AR11 ASAP send it with certifed return reciept ( for all family members) and at the time of Interview change your address on I-485 so that I-485 approval or GC card reach to you correct home address
4. Should I take a lawyer with me for interview. Is their a long wait at the Newwark office even though they give you an interview date. My lawyer is charging me $500 for first 3 hours and $200 every hour their after and he told me that usually it is 3-4 hours of wait before the interview.
-- lawyer is correct it may take 3-4 hours but Interview time will be maximum 30 to 50 monutes, if you feel that taking lawyer helps or gives you peace of mind take him 500 is normal and ot will not take more than 3-4 hours ya lawyer naal Sidhi gal karoo ki chaye 3 ghantey ya 4 ghantey ek fix amount kar lavoo, vaisay 500 ya 700 koi buri deal nahin hai
Does any once has experience in this area.
5. Do they stamp your passport on the same day? or do you just get an approval letter that day, if you get approved.
--- they stamp if everything is OK and they dont need any other document from you or employer.
** just take 2 new passport style photographs with you becase after September they are going to use Frontal Photographs thease photographs are same as used for Visa stamp from DOS, after interview if they ask for new style photographs give them, write your Name, DOB, A# back of photographs with pencil

Ginnu,
Thanks for your reply. I spoke to my lawyer and decided that I'll take him with me to the interview, it helps in 10% cases. Eventhough my case is very simple and straight forward. The catch is that my lawyer has another engagement for 9/1 and so will check if we can get another date within 1 month, If that works out than i'll delay my interview by 1 month and take him along. Bhaut Bhaut DhaanVaad for your response. Good Man thee Lal Taan. regards,

-- Remember if you request to reschedule the interview date then the next date of interview may take 5-7 months
If that works out than i'll delay my interview by 1 month and take him along.

My I-485 approved, but I-140 is still not updated on the net

Is it by default I-140 gets approved, if I-485 is approved. Please let me know

I140 pending, went for 485 interview, not approved

My case is interesting, Got RFE for I140 in May, replied in July, status changed to RFE received. Got AOS interview letter in few days after that, went for interview and was told since I140 is still pending , they sent letter by mistake. wasted whole day for nothing...................
