I-485 I-94 question.

When I file I-485, should I inlude recent I-94 issued with H1B1 approval notice last month, or the I-94 I used to enter USA last year, or both should be included. Thanks,

What happens if I-94 number's doesn't match?..My I-94 number on H1 extension is DIFFRENT from the LAST I-94 received at Port Of Entry.
And, this POE I-94 is already expired where as I have the VALID I-94 number that came along with my H1 (valid until July 2003)

Did you enter US after h1 was approved? If so then you ahve a I94 mess you need to fix.
If not, sometimes INS just cross references the 2 I94s. Make copy of the old one and have copies of receipts and approvals for future verification , just in case. You are fine.

Here is the exact scenario what happend:

FIRST I-94(1996) - Entered into US:

I-94 Number is: 8679945XX XX

SECOND I-94(1999): Went home for vacation got new I-94:

I-94 Number is: 7700365XX XX..-- Valid until Dec 2001-

H1 Transfer A ->B(2000):

When my H1 was transfered to NEW company, H1 approval has I-94(8679945XX XX valid Jul 2003) instead of LATEST I-94 (7700365XX XX - expired)..looks like they have taken I-94 number from H1 papers instead of from LAST POE I-94 Number....and H1 is VALID until July 2003 but LAST POE I-94 expired on Dec 2001...

Do you see any problem?..As per my Attorney, he says it's okay. I am not sure about it, that's why I like get your opinion from you.

theoritically

a person's i94s are supposed to be cross referenced. The mess here is that the I94s kind of branched into 2 versions of cross reference. As the lawyer suggests it is not a big issue.
All will merge into 1 version once you travel out of US and come back with fresh I94.

I had same issue

I had the same issue when I filed for I485. My lawyer was saying to file 245I , but I refused. I talked to INS officer. He said everything is fine.But my lawyer still feel that its a problem . We filed 485 in Oct 91 . I got the interview call on 22 July. Dont know the reason yet.

You are supposed to surrender your I-94 when you leave the country. Its no more valid. When you come back you will get another one.... which is valid until the date mentioned on it or until you leave the country.

If and when your H1 expires and is renewed. You get a new I-94 along with the approval notice. (Remember you had to submit the copy of I-94 for H1 renewal) both the I-94's are now crossreferenced. However only the new one that came along with the renewal is valid. You should surrender both the old and the new if you leave the country again.
