Hello everybody,

Good Morning.

I have an issue. I am with Company A and want to transfer my H1B to Company B. Here is the situation.
140 got approved, got EAD's and past 180 days also. Almost 5 years over in 6 years. My h1b expires in July 2008. Company A applied H1B extention based on 140 approval. I have one job offer from company B.
What I thought is Do premium processing get H1B approval from Comapany A and transfer to company B, but it takes time atleast 20 days.

Can I do this way like Transfer current H1B to company B apply for extention in Company B using approved 140 of Company A? Will I get 3 years extention or not?

Is it possible? I donot know. Are you sure about this?
 
Yes, it's possible. You can ask for 3 year extension since your I-140 is approved. It doesn't have to be the company applying I-140 that does the asking.

i did the same thing..

I am in the same boat - found a new job - and sent all the required papers to the new company's lawyers (485 notice, approved 140 notice, existing h-1b's etc) - they filed for h-1b transfer with premium processing.
the pp takes about 7 days - so you should be fine if you act fast.
 
Already Company A applied for extention based on 140

still can I apply extention based on company A's 140 by going to company B?
 
After I transfer my H1b to comapny B

Would I get any RFE's for company A? If yes, How can I answer for them.

let's say company A cancelled my 140, do I get any RFE for that.


Can I transfer my H1B to company B? Would be there any effect on GC process? becoz company A is sponcering GC.

As long as you port your GC sponsorship from Company A to Company B using AC21 portability, your GC process will not be affected.

Read about AC 21 in this forum.
