I-485 / H1B / Canada PR

Dear friends

I485 pending from 2 years and currently working on H1B and have Applied for Canadian Perminant Residency and received the approval.

Problem is Canadian PR expires after 2 months and it cannot be extended and have not yet received 485 approval.

What should i do now. Please advise.

Talk to canadian embassy,bufallo

one of friend is also in same boat.They talked to canadian embasssy and closed the file time being and they can instate the file whenever they want.Whenver they are ready they can call ebassy to process it agaign.
 OR
You can land in canada apply for all and open a bank account and come back t US.

Dear friend,

i did talk to canadian office and they told if i dont land before expiration date these papers will be void and i have to start a fresh application from the begining for PR papers.

i thought not to waste this opportunity and plan to settle in canada, but i am in middle of part time graduate studies and another 3 semisters/8 months required to complete my studies.

i told this situation to canadian office and they dint give any advice other than telling papers will void after expiration date.

don’t know how to retain these papers. If i go to canada on PR papers and while coming back will my H1B visa be honored to reenter at US post as i am currently working?

If i go to canada how many days should i stay and what all the things to be completed before returning back.

If you can talk to your friend and let me know how to handel this situation, i will be very grateful to you as i realize very rarely we get good friends and good advice.

go ahead and land

if you have a valid H1 visa or a H1 apporval with a valid I-94 you can come back to the USA within 30 days.
there is no way you can extend the canadian immigration deadline, also with the new immigration laws it will be so tough to get thru the immigration rules that you cannot even think of giving up your papers.
 
H1B visa will not be honoured to reenter once landed in Canada through PR papers

one of the colleague Canadian Citizen told H1B visa will not be honored to reenter once landed in Canada through PR papers as H1B is issued based on country of origin. Using PR will loose the H1B validity.

can some body throw light on this.

You can re-enter after landing

I am sure that you can re-enter with your H1B after landing. One of my friend who is a landed immigrant( indian) got h1B papers. One more good thing is that after landing, you dont need visa to enter into US as Canadian Citizens and Landed Immigrants dont need any Visa to come to US, you only need work permit and your H1B papers gives you the work permit. I think you should be OK to come back to US after landing in Canada. But be prepared to answer while landing and coming back.Best of Luck. Welcome to Canada, a lovely country.
 
Some Canadian Landed Immigrants will need visa to enter USA

As far as I know, only Canadian citizens are exempted from passport visa stamp. Certain Landed Immigrants still require a pasport visa to enter the USA from Canada. Exceptions would be Landed immigrants who are passport-holders of other Visa-exempt countries.
