Fourth: Certain Special Immigrants: 7.1% of the worldwide level.

Fifth: Employment Creation: 7.1% of the worldwide level, not less than 3,000 of which reserved for investors in a targeted rural or high-unemployment area, and 3,000 set aside for investors in regional centers by Sec. 610 of P.L. 102-395.

4. INA Section 203(e) provides that family-sponsored and employment-based preference visas be issued to eligible immigrants in the order in which a petition in behalf of each has been filed. Section 203(d) provides that spouses and children of preference immigrants are entitled to the same status, and the same order of consideration, if accompanying or following to join the principal. The visa prorating provisions of Section 202(e) apply to allocations for a foreign state or dependent area when visa demand exceeds the per-country limit. These provisions apply at present to the following oversubscribed chargeability areas: MEXICO, INDIA and PHILIPPINES.


5. Thanks for the info. I am aware of these preferences but do you really think that the officers at TSC follow these preferences to adjudicate few cases out of the thousands pending?

I send letter twice to my local congressman and senator. I think this worked out to speed up my case.

Why don't you all follow this. Sending request to your sen or con man you are not gong to loose anything. Give it a try.

First of all, congratulations!! Hope this approval alleviates the stress that you and your family have no doubt gone through thanks to the BCIS/INS.
When my wife's application for an Advance Parole was pending for several months last year at the time when they were taking 50 to 60 days to process that kind of case, we had spoken to several congressmen and senators from our state. These guys actually made several inquiries into the case but all of that was to no avail. She finally got her AP after 7 months.
So, I wonder how much congressional/senatorial influence would work in the days in which 50% of americans are in favor of reducing immigration to the country. Afterall, with the elections approaching, the polititians are likely to act in accordance with current public opinion.
That said though one may have nothing to lose by going that route.
