Hi, I have a very basic question to fill out I-485. I am applying to change status from F-1 (student) to conditional permanent resident based on my marriage to a US citizen. I am a Japanese citizen.
We are concurrently filing the following documents and my question is about I-485.
I-130 (petition for alien relative)
I-485 (application to register permanent residence or adjust status)
I-765 (application for employment authorization)
and probably travel approval, too.
In Part 2 Application type on I-485, shall I check h (I am applying for an adjustment to permanent resident status because, h. other) and explain that I am a spouse of U.S citizen ?
Below is what the form says:
Part 2 Application type (check one)
I am applying for an adjustment to permanent resident status because:
a. am immigrant petition giving me an immediately available immigrant visa number has been approved.
b. my spouse or parent applied for adjustment of status or was granted lawful permanent residence in an imigrant visa category that allwos derivative status for spouses and children
c. I entered as K-1 fiance of US citizen whom I married within 90 days of entry or I am the K-2 child of such a fiance
d. I was grante dasylum or deriverate asylum status as the spouse or child of a person granted asylum and am eligible for adjustment
e. I am a native or citizen of CUba admitted or paroled into the US after Jan 1 1959
f. I am the husband, wife or minor unmarried child of a CUban described above in e ..
g. I have continuously resided in the US since before Jan 1972
h. Other basis of eligibility. Explain, If additional space is needed, use a separate piece of paper.
As I am already in the US with F-1, I am assuming "h" is the one I should check, but I am not confident.
Please advise.
