I-485 filed on future employment basis

Got my Labor and I-140 approved by company X (that time I was on company's payroll). Then I joined company Y on new H1. Company X filed I-485 on Future emplyement basis without joining (14 months back) them. Got laid off by company Y. Was without job for 8 months. Nither company X nor myself could get a job for me. Then joined company Z on permanant basis on EAD. Also got EAD renewd by myself. I have come to know from a very competent person that Company X can withdraw my I-140 any time even after 180 days. I am very much tensed. Can someone please guide me on this. Also I have no attornery. The attorney who filed my I-485 is no more in practice. What should I do.

If company Z offers continued employment then I think you are good.


After 180 days now you are a free from 140 or any withdrawl.

Don't worry.
After 180 days of I-485 you own the GC process, nobody can do anything about it.
But the catch is that you have to be employed with new company.
If you just joined the new company then it's good to have termination letter from your old company.

Don't worry. Once you crossed 180 days barrier, you are safe(even if your sponsor revokes I140) because you have availed AC21. There is no rule that you have to inform BCIS about job change. If an RFE comes, then simply submit a letter from current employer with current pay stubs. Don't worry about job title.
You should be OK.
 
Thanks everybody for the prompt and encouraging replies. But there is one thing. What is AC21? I haven't applied for this. I am simply working on EAD. Could you suggest me about Attorney (as I have mentioned above). I don't have any attorney.

You dont need to file for AC 21. At least thats what my attorney told me. If you get an rfe then file your new companys Apt letter and pay stubs.

AC21 is an immigration law and not a form that many people believe it is. It stands for American Competitiveness Act for the 21st Century. When you reply to an RFE, if any, you could mention that you have changed jobs and want your application to proceed under the AC21 law. You will need to provide supporting documentation such as pay-stubs, employment letter, etc. as required by BCIS when you respond to the RFE.
 
Thanks a lot . But could you suggest me about Attorney. Because my old attorney who filed my 485 is no more in practice. In other words , not traceable. Is there any need to hire a new attorney right away. ? In case if there is any RFE then how I will come to know about it.? Also please suggest me one more thing that whether my old company X has withdrawn it or not? Its a silly question but just want to remove my doubts.

In case there is an RFE, it will go only to your attorney. My suggestion is find an attorney now and send the appropriate form to change the attorney. Otherwise send a letter saying that you are going to represent for your case without an attorney.
