Hello:
I applied concurrently last year (June 05) under EB1 (OR) category at VSC. I-140 was approved Feb 06, my I-485 is pending and the latest news is it is waiting on some background checks. I have a question and would appreciate some guidance. If I on my own accord quit and take up a new job, which is similar to my existing one, but with better prospects and benefits, what
(i) What can my present employer do? Can he revoke my approved I-140 petition and inform USCIS that I have quit? and if that happens, is USCIS required to take action on that?
(ii) How will it affect adjudication of my I-485? I believe USCIS approves I-485 on the hope that I will be continued to be employed by my current employer? Will there be any adverse implications, if my curent employer is wlling, but I myself on my own volition decide to quit?

As always any input, suggestions welcome. Thanks !!!!

-------------he can send request to revoke I-140
and if that happens, is USCIS required to take action on that?
------------- your I-140 is approved and I-485 is pending more than 180 days and you are eligible for AC21. you have to send new employer parmanent job offer letter with same/similar job duties and can request USCIS to invoke AC21.
(ii) How will it affect adjudication of my I-485? I believe USCIS approves I-485 on the hope that I will be continued to be employed by my current employer? Will there be any adverse implications, if my curent employer is wlling, but I myself on my own volition decide to quit?
------------ you can join new employer and you are protected by AC21
As always any input, suggestions welcome. Thanks !!!!
