Hello,
Thanks for your time in visiting/answering this :)
I Know USCIS usually check the employer's 'ability to pay' the beneficiary at the I-140 stage. But I was wondering if anyone has any insight on:
1. Anyone experienced an RFE or Interview to prove the employer's ability to pay at the I-485 stage
2. I am on H1. so my employer is obligated to pay the h1 prevailing wages at this time. This salary is quite a difference than the LC salary; which the employer is obligated to pay only after the adjudication. That said if there is in RFE at the time of adjudication for the prevailing wage: How to prove it when i am paid the H1 salary

My details:
PD: Aug 2003
I-140 : approved(EB2)
I-485 : Pending
Still in H1 10th year. but applied for EAD renewal.

GC is for future job. H1 salary is according to LCA that is filed with H1 Petition. GC is for future permanent job after I-485 gets approved. USCIS can ask the ability to pay at the time of I-140 approval or before approving I-140. Once I-140 is approved generally USCIS don’t ask ability to pay documents from employer.
H1 salary can be different then the salary written on LC. LC is for future job, I-140 is for future job.
