I-485 (EB-2) approved following Mandamus filling

Dears friends and name check victims,

My wife and I had our I-485 approved today after filling a Mandamus complaint in Court on October 25th, 2006. The interesting point is that we filled the complaint exactly 329 days after we filled our I-485. Surprisingly, the approval happened quickly after we brought the issue to the Court.
For information, I am the primary applicant and was stuck in name check since end of October 05 (according to what I was told during an Infopass). Not surprisingly, my wife's name check came back clear almost immediately early November 05. Not such an unusual pattern :rolleyes:
I was EB-2 (worldwide) and I will remain on this forum to answer any question you might have, since this forum has been an extremely precious help for me.

I wonder if a group of individuals could file a class action lawsuit against USCIS and their practices. I am not seeing a reason why FBI checks delay the piece of plastic. They could do it in background. They call it "background".
 
That's right they could issue a temporary plastic subject to FBI namecheck and count all these days against the citizenship requirement. I filed my 485 in March 2004 and was stuck in namecheck, now it's both namecheck and retro... what a waste of 2.5 years.
 
Hi I'm so glad to find this forum. serious question from GED69. how to get FOIA from FBI, and did the senators and congressmen replied to your request fast. I've applied for I-485 01/2004 and am stucked with security check since then. no answer from anybody,only received letters that you have to wait. Hope you get my request and answer to me.

How did you file your WOM lawsuit?
I have been speculating about filing WOM lawsuit but wasn't sure about the success rate...The lowest wait period that I saw was for 1 year 3-6 months by bunch of EB1 folks! I have followed the threads from PUBLICUS and have little idea about filing Pro Se

China born Canadian citizen with I485 pending for 11 months

I am a China born Canadian citizen with I485 stucking at name check for 11 months. Any idea what should I do? Thanks.
