I-485 denied with no notice - Please help

Yes ... in filing the MTR it is very important to point out the evidence that indicates you had could not have reasonably had any knowledge of the November 2005 denial ... fingerprints in 2006 + online case status + H1B extension getting approved in December, after the alleged November denial. And at the Infopass, try to get the reason for denial if possible. It is most likely something stupid ... for example, somebody else on this forum had their I-485 denied saying the I-140 was denied, but their I-140 was approved, and the I-140 referenced in the denial was for another company and another person.

very sorry to hear that but dont forget that you are much better than many since you have good proof on record with your FP and online status..

duncanidaho, has compiled some good info.

1. take a screenshot of online status, ( Alt+ PrtSc ) and Ctrl+v in ms paint or something

2. save as from browser also to a HTML file.

3. record the 800 status message, if possible also start a conversation with cust. rep who will tell you its pending.. ask her something like " you mean status as of today, which is July 19th 2007 is pending?" so that that goes on record too.. ( use an mp3 player or a micro-cassette recorder.)

4. follow all other instructions of duncanidaho also. that was good post..

5. Most imp. dont panic, dont lose heart... you are way better than people who were actually denied and communicated rather some mistake with their system...
 
Thanks a bunch DuncanIdaho,1victim and Jackolantern.I appreciate a lot on your suggestions that you provided me. Infact,I already did take a screenshot of the status and I have an Infopass appt next week with a officer.
My attorney had asked me not to contact through sources when they are finding it themselves but I went ahead and took a Infopass appt.I think that they may have gotten a RFE or something from them and could have ignored it.

I have not changed companies since Labor and I have been with the same company since 2001.I did not have a address change neither did the lawyer's firm until this year.

At this point as you have suggested I am getting the status from the InfoPass officer and try to also approach through other channels like Senator,Ombudsman knowing what the reason is from the InfoPass Officer.

It came as a big shock to me when I learnt this but I am recouping myself and trying to find a remedy.Your suggestions have been wonderful DuncanIdaho and it would definitey help me a lot.

I am going to suggest these to my attorney and ask him to do a MTR asap with the Sworn affidavit but he keeps telling me that they are busy with July filings.

If I have to change a lawyer at this time,would I need to do a G-28?

Your best bet for a good formal answer on I485 denial is,

1) Senator or Congresman Inquiry or
2) AILA Inquiry thtough lawyer

Thanks banta4gc for your suggestions too.My lawyer said they already initiated a request through AILA.I havent contacted the Senator yet but will do that after the InfoPass to find out what went wrong so I can explain that in the note to the Senator.
 
Jay, I am sorry for you - what a mess, USCIS...

Where did you file your application? TSC or VSC? If VSC, then I assume you did not get the transfer letter from VSC to TSC by snail mail - confirm.

Sorry to see the goof up on your case....I wish you attorney took up your case as his top priority...I'm sure infopass would resolve all your problems..there's been a major screw-up with your application that they will realize and fix ASAP....please keep us updated...

I have read in other members post and in one attorney site that, even if the 485 is denied or if they send the intent to deny letter the online status will still be pending. So, your case might have been denied. Most probably reason being RFE response. Your attorney office is responsible for this. You could sue them too.

Also, I am wondering how can you not ask about the status for such a long time. 2002 RD people got their GC's in 2004 nov dec time frame.

Anyway, past is past. I think you ask your attorney to file Motion to Reopen(MTR). Get some reading from forums. give a MTR search in this forum. you will get the info you need.
 
Thanks KnowDOL.Let me explain what I went through in 2004- 2005.I was not married around that time and so I kept postponing my fingerprinting notice twice .I guess the USCIS had sent an RFE about that to my attorney asking why I am postponing.Since I was not married ,I didnt want to fingerprint because I could get my Green card.My attorney responded that I am not available right now and requested to postpone the fingerprints one more time.

They actually scheduled a new fingerprint for me in Jan 2006 and this notice was generated on Dec 2005.They said in the notice this is the final notice and if I dont appear my case will be abandoned.So I went and gave the fingerprinting this time.But they say they have denied my case in Nov 2005 by sending a letter to the attorney.I wonder what happened.Some one really needs to investigate at USCIS as to what went wrong with my case.

Cool, 485 denial due to missed Fingerprint notice is failry common....
I guess you could talk to attorney and work on resolving the issue...

And the surprising thing, is that you did not even apply for EAD/AP....each year....that's another good way to keep track of 485 denials...each year...

USCIS is so messed up - when it comes to 485 denial......For every RFE, an email update happens to 485 application....
But, for the most important 485 denial - there is no emial trigger...HOW STUPID CAN USCIS BE????

ONE NEEDS TO STRESS THE IMPORTANCE OF 485 DENIAL NOTICE VIA EMAIL to CIS Ombudsman - so that they can push USCIS to push in for this crucial change in their IT systems...
