I-485 denied, Pls help

My I-485 is denied because of failure to attend Fingerprinting for the 2nd time as I never received the 2nd FP notice.

I was outside the country for a couple months when I could have received the FP notice.

Don't know under what condition/grounds can I file MTR ? Any lawyers or experts that can guide me here .

Will I have a valid case ?


Pls help.
 
So you failed the 1st FP appointment already and then left the country ?
How did you travel ? on AP ? Does USCIS know about you traveling ?
 
I think s/he meant missed the 2'nd FP.....

PM RealCanadian or other knowledgeble members for course of action.
But reading form the other posts I guess you should file MTR asap I think.

PS: I am not a lawyer....
 
My thought was he missed the first FP and the second chance for FP appoinments , probably they think the case has been abandoned from his side !!! That's a big problem , if he's not covered when he apply for MTR !!! Contact the best lawyer near you and fight this fast , while you can , i hope !!!

I attended the Ist FP but was not able to attend the 2nd FP because of which they might have denied.

I didn't receive any 2nd FP but the notice says that my I-485 was denied
because of failure to attend the 2nd FP.


I am in touch with the lawyer but wanted to get some info from guru's out here abt the different reasons for openning an MTR that would make my case to hold ground.


Pls help me ?
 
I think that with an MTR will bring your case back on track , but do not wait until is too late !!!

go to Local office and talk them. Tell them what happened.
 
Did your lawyer received the 2nd FP notice or not ?. Usually USCIS will sent to you and as well as to your lawyer.

I have replied to your other forum in "I-485 case in Vermont Service center" Please check that.. it may help..As i'm in the similar (but not same) boat..

I just received a letter from USCIS. It says that my wife's I-485 has been denied due to failure to appear for fingerprinting.

Our first fingerprint notice was received in November 2004. We went to ASC in December 2004 and already had fingerprint taken.

Actually I called VSC last month. I was told my wife's FP was expired. They will send me a new notice in 60 to 90 days. But we never received the 2nd FP notice.

In the letter, it does not say whether my wife failed the 1st FP or 2nd FP. Anyway, we only recived one FP notice and she did go to ASC and had FP taken.

My I-485 was approved in June 2005. My wife's I-485 was delayed due to security check.

I plan to file a Motion to Reopen.

Do you have any progress on your case? Thank you,
