I-485 Denied;please Help!!!!!

I-140 third preference was approved June30,2007-It was never denied.It was filed Oct 2006, concurrently with I485


I-140 second preference was denied -Aug2007.We appealed...

Sorry to ask to uncross your fingers but come to reality please, and just note that your EB2 is hard to get approved since your labor seemed to be advertised for EB3 candidates.

If your I-140 is safe, then wait until the EB3 cut-off date is current and file AOS under EB3.

CONSULT WITH YOUR LAWYER AT THIS TIME. IT IS VERY IMPORTANT THAN WAITING ON YOUR EB2 APPEAL TO SEE OF ANY APPROVAL. WAKE UP!!!

If the only status for you and your husband is AOS pending, than the best you can do by filing appeal for denied I-140 in categoryEB2 is to win the time and hope that EB3 is current again soon for EB3 RoW.

Since EB3 is current you may file I-485 based on the approved EB3 I-140 and you are fine. If you get denial of your appeal for EB2 I-140 before your PD is current for EB3, you must leave the country not to be out of status.

Please note that his EB3 petition for AOS has been denied due to visa number not being available which I am not sure if or no will invalidate the underlying I-140 petition.

In her previous posts she said it was denied in Dec 2007.
I believe her husband's I-140 in EB3 is still valid in spite of I-485 rejection.
 
You must have meant "When", not "Since".

"Since EB3 is current you may file I-485" implies the EB3 PD is now current, which is false and has a very different meaning from "When EB3 is current." I normally ignore typos, but I will point one out if it significantly changes the meaning of what is being said and/or is likely to confuse the readers.

I find you very interesting in analyzing indicative mistakes thus I have asked you to look for mine too. Even the above will take extensively unusual turn SINCE AND WHEN, I don't think the user is that unintelligent who is not able to understand the discussion that took place in this particular thread and sit blind-folded and will file EB3 right this instant, which is highly unlikely situation that could have happen from his particular post.

Well, there are users who are unclear on what it means for the PD to be current and if/when theirs becomes current. For example, this thread wouldn't exist if the user who started it had that understanding.

Once the thread being started and the continuous flow of discussing started to shower, it would be crucial to the fact that if such post was the original theme of the thread, I would too have given my instinctive thought and call it “disturbing”. The user has presented the fact towards the end or in the middle where as the user who started the thread being fed with much of information on how to process with the underlying application, I would have given less thought in correcting the blunder.

I think the above quote has to be read in conjunction with this one to fully comprehend the meaning of what labordrags is trying to say. My mind is still reeling from the bold and capitalized 'SINCE AND WHEN'.

The conversation probably did that to you. It doesn't mean anything deep. All I wanted to say was correcting simple mistake make sense but making it all time high doesn't. Some users are trying to correct the mistakes where one sees the lack of noun, pronoun, adjectives, conjuctions etc....you name it.

Don't bang your head that hard. Try making sentenses from SINCE and again try it from WHEN and see the difference. as..

Since EB3 is current you may file I-485 based on the approved EB3 I-140 and you are fine.

I got an e-mail today that my I-485 has been denied.But my I-140 is still pending. What should I do?

Do you have any other Status like H1. Or if you are a dependent stop working and apply for change of status to H4. There is chance that you may have to go out of country and come based upon your situation.
