i 485 denied need help

old employer told he had withdrawn the I140 after one week of its approval. but no LUD changes or message so far...
I 485 is pending for more than a yr...
so not sure whether the case is eliglible for AC21.
old lawyer doesn't support us much....
the new company lawyer says he needs something in letter from USCIS to take further action.
so waiting for the letter.

Banama - I am in a similar situation, My old company revoked the I-140 and I didn't recieve any NOID and a denial letter. My lawyer is preparing a case to file an MTR, Let's see what happens. :confused:

can we file MTR even before getting denial letter? b'coz we haven't received the letter till today....
the lawyer says we should get the letter first to do some appeal...

Banama,

I too contacted my attorney, she too told that, she can do nothing, till we get notice. so keep ready everything and just start immediately after you receive notice.
 
Talk to the congress man's office.

They should be able get more info from USCIS, than what we get.

Hi Banama

I am in the exact same boat as yours. I called VSC today and they said they recieved I140 revoke from my old employer. I changed job only after I140 approved and more than 280 days. Also i did send AC21 but the lady said she has no record for it. She said that my files I140/I485 are in clerical section waiting for them to send letters. But i dont know what letter they will send.. Will they Send NOID or Denial.?

I am praying to GOD that they send NOID instead of Denial.. because i am thinking denial means we have to send MTR which could take some time whereas NOID means we will have 30 days to respond.

Gurus please suggest what are my options
 
Finally got the I485 denial notice...

And its totally a diff reason for our petition's denial. It says that my H1B was expired on Sep 19th 2003 and we filed our petition on Sep 23rd 2003. Actually my previous employer filed my H1B to be extended from March 2003 upto Feb 2004 (adding the no of days out of USA) and it got approved by CA service center only a few days back(Jan 2005). My 6 year period expired on Sep 19th 2003 but at that time this H1B was still pending to be approved. So, I hope I was in status at that time. I just need to see the approval notice from the lawyer and I hope they approved for the entire period. If not, I will be in soup.

Do you know how to reopen this. Because this notice says there is no appeal on this. I am not sure if my old lawyer can help me in this. Can I do it myself to do a MTR?

Any LUD changes?

I seen LUD change on 01/28/05 on my I-485 and my dependents I-485, but no change in a message. I am bit worried that they may issued notice? may be monday I may here something. I dont want denial notice and want approval notice :(

We both filed MTR, got EAC# and again waiting for decision. as long as something pending with USCIS, we are legal to stay till get the decision.

Noid was replied 12/23. After waiting for more than 60 days, this morning LUD changed for me and my wife 3/10 and 3/9
What could it mean?
I am very nervous, is it denial? Please...
