Guys, I have a question. If I received I-485 denial (EB-3) will I be automatically place in removal processing or deportation. Can I aply again for green card in future or I must leave USA a.s.a.p.
Thank you for your answer.
:( :( :(

My I-485 was denied because my sponsor revoked i-140. I couldn't use AC-21 (too short time).
I am really worry now. I don't know what to do. Mabye to file PERM through another sponsor, for whom I am working now.
But I don't know if I can apply again for Green Card after denial.
Please answer. Thank you!!!!!!

If you are in H1 status now, yes you can file for GC with your current employer (or any other employer for that matter). Your previous denial is not going to affect your future GC applications.

zborek1:
- Was you I140 approved?
- If yes, was it more than 6 months of 485 application, before you joined another employer?
- Did you get a Notice Of Intent to deny (NOID)?

If you I140 was approved and I485 > 6 months, you should file an appeal and have AC21 paper ready. You have good chances of approval as long as the job duties are the same.

If you I140 was approved and I485 < 6 months, you should still appeal with AC21 papers; there is a slim chance of approval.

usually USCIS sents a NOID before denial.
Consult a good lawyer for these things? What does your lawyer have to say?

I-485 denial

I have the same situation. My lawyer suggestes we can reapply another I-485. Is it possible to reapply I-485 when the earlier one is denied and more than -3- months have elapsed? For filing MTR (Motion to Reopen) what is the timeline?

Thanks in advance!!
